Discussion and possible action to approve the following line item transfer for the Elections department: Acct. Number Acct. Name Amount Bal. End Bal. From: 001-0107-6705 Election Expense $3,450 $4,160 $710 To: 001-0107-5003 Overtime $3,450 $2,550 $6,000 Issue: The Department of Labor - Wage and Hour Division (DOL-WHD) conducted an investigation of the hours worked in excess of the regular 40 hours per week by Election Office staff within the previous two years to determine if they were under-compensated for the hours they had worked. At the conclusion of the investigation, it was determined that these four employees were owed a cumulative total of $5,856.47. Solution: Transfer funds from the Elections Expense account (no more elections to be conducted in 2014-2015 fiscal year) into the Overtime account to cover the shortfall and be able to "cash out" these employees with no impact to the General Fund. Result: The employees will be paid what was determined by the DOL-WHD they were owed and the County will be able to provide the proof by the deadline date.
Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member will be allowed a total of Three (3) minutes within which to make any/all public comments.

Discussion and possible action to approve payment of Compensatory Time for Twenty-One (21) Webb County Sheriff Bargaining members in accordance with Article XIII (Special Benefits); Section C., of the Collective Bargaining Agreement for hours exceeding 480 in the amount of $13,864.13 contingent upon approval and verification by County Auditor and authorizing the County Judge to sign all relevant documents and any other matters incident thereto. [Regular Overtime Accounts #001-2001-5003-B, #001-2060-5003-B] Issue: In accordance with the Collective Bargaining Agreement (CBA) all hours exceeding 480 for comp time earned must be paid out to Union members. Solution: Payout all hours over 480 to comply with Article XIII (Special Benefits); Section C of the CBA. Result: Compliance with CBA and a reduction in Comp time hours earned by law enforcement personnel. Discussion and possible action to approve payment of Compensatory Time earned for Six (6) civilians for hours exceeding 240 in the amount of $58,621.94 contingent upon approval and verification by County Auditor and authorizing the County Judge to sign all relevant documents; and any other matters incident thereto. [Overtime Account 001-2061-5003-C]. Issue: All compensatory time earned that exceeds 240 hours must be paid out to employees. Solution: Transfer funding from other operational accounts that have savings to cover expense. Result: Lower Compensatory balances for civilians exceeding the cap. Discussion and possible action to approve the following line item transfers: Issue: Compensatory time earned exceeding 240 hours must be paid out. Solution: Utilize end of year savings from other operational accounts to cover expense. Result: Reduction of compensatory time earned exceeding 240 hours. Compliance with DOL rules.
Discussion and possible action to transfer and allocate county personnel savings funds for the month of August 2015, in the amount of One Hundred Seventy Thousand ($170,000.00) Dollars, into account #603-0101-8801 (Capital Outlay) and account #604-0101-8103 (Building Improvement); and any other matters incident thereto.
