4. Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.

CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners. The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. Discussion and possible action to transfer Slot #1375 (Warehouse Inventory Technician) from Road & Bridge Department to the Human Resources Department; and any applicable Civil Services guidelines, and any other matters incident thereto. Issue: The Civil Service Commission ordered that the employee be transferred from the Tax Assessor Collector’s Office to another department and considered the grievance mutually resolved. Solution: Transfer employee to comply with mutually resolved agreement. Result: Comply with Civil Service Commission finding and order.

16. Discussion and possible action to approve an amendment to the county Personnel Policy (Section 4.05- titled “Application for Employment”), to include that all appointed positions will require the submission of any and all pre-employment forms requested by the Human Resources (HR) department such as job application and any other pertinent employment credentials deemed necessary by the HR department prior to employment with the county; and any other matters incident thereto.

Discussion and possible action to ratify and approve retaining the law firm of Allison, Bass, and Magee, LLC, as retained outside legal counsel to represent Ponce Trevino in Cause Number COA #04-18-00833-CV / TC #2017FLI001815, In Re: M.A.G. and Z.A.G.; and authorizing the County Judge to execute any and all relevant documents and any other matters incident thereto. [Executive Session is requested pursuant to Texas Government Code, Title 5, Subchapter D, Section 551.071(1)(A) (Consultation with Attorney regarding pending or contemplated litigation)] [Account #1001-1130-001-432001 (Professional Services)]

18. Discussion and possible action to approve submitting the application for participation in the LTSS Managed Care Organization – Aetna Better Health of Texas provider network. The Meals on Wheels program will continue contract rate of $6.12 per unit and provide 16,130 home delivered meals. No impact to the General Fund. [Account #2371-5260-521-470000] Issue: The LTSS MCO - Aetna Better Health of Texas provider application must be updated for continued participation in the provider network. Solution: The approval of the Commissioner's Court will authorize the LTSS MCO network provider (Aetna Better Health of Texas) to enter into a service agreement to provide home-delivered meals. Result: The Meals on Wheels program will continue to provide home-delivered meals through a partnership with LTSS Managed Care Organization - Aetna Better Health of Texas.

19. Discussion and possible action to authorize the reclassification of Slot #2086. A Supervising Attorney is assigned to each of the felony courts except the 49th District Court. Department is in need of a Supervising Attorney for that court, and requesting a reclassification of Slot#2086, and any other matters incident thereto. If approved by this court, this reclassification will be taken to the Civil Service Commission for certification. [Account #1001-1130-001-431007-015 (Operational Reserve Wage Classification Study)] Issue: Slot #2086 is currently classified as an Assistant Public Defender II. A reclassification of this slot to a Supervising Attorney slot will allow our office to have a Supervising Attorney in each felony court. Solution: The reclassification of the Assistant Public Defender II, Grade 23 position (Slot #2086) to a Supervising Attorney Position, Grade 25 will resolve the issue presented above. Result: A Supervising Attorney will now be assigned in each felony court.

20. Discussion and possible action to authorize the Purchasing Agent to solicit Request for Qualifications for Architectural / Engineering Services to act as Owner’s Representative in overseeing the process of construction and renovations to the Webb County Fairgrounds project. The Owners Representative primary role is to represent the interest of Owner (Webb County) in regards to and not limited to ensuring that the quality of both materials and workmanship are in accordance with design and construction plans and specifications as approved by Owner and to further serve as the Owner’s eyes and ears independent from the Design Team and Construction Manager at Risk Contractor throughout the design, construction and completion of this project and any other matters incident thereto. [2020 Bond Series – Webb County Fairgrounds] Issue: The Webb County Fairgrounds project is estimated to cost $45 million to include new construction and renovations to existing facilities. The Court is requesting an independent contractor to oversee the process from beginning to end and provide frequent reports and recommendations as the project develops. The Owners representative will provide oversight and report on any recommendations, discrepancies and progress of design, construction and all other components of the construction such as compliance and project estimates being recommended by general contractor and design team to reach a guaranteed maximum price. Solution: Authorize the Purchasing Agent to seek RFQ for Owners Representative from qualified Architectural or Engineering firms that have substantial experience providing construction management services for project scopes of this magnitude. Result: Secure RFQ proposals for Courts consideration in selecting a qualified Owners Representative independent of the Design Team and Construction Manager at Risk.

21. Discussion and possible action to authorize the Purchasing Agent to purchase all necessary law enforcement equipment for the previously approved leased police package vehicles in an amount not to exceed $1,700,000.00 from Silsbee Ford, Inc. (State Cooperative Contract / Good-Buy #20 8F000) and in accordance with the Texas Local Government Code; Section 271.102 (Cooperative Purchasing Program Participation). [Account No.1001-1130-001-470000 Capital Outlay]

22. Discussion and possible action to authorize the Purchasing Agent to solicit Request for Proposals for Leasing of Webb County School Lands for Renewable Energy Development and any other matters incident thereto. Issue: Webb County currently leases property designated at school lands for Grazing and Hunting operations. Webb County and the School Districts are interested in using the same properties for renewable energy development utilizing wind, solar or both to generate renewable energy/electricity. This project can potentially generate substantial revenue for the benefit of the school districts and for Webb County. Solution: Approve the authorization to solicit for competitive proposals from Wind and Solar Energy firms interested in investing in a long-term lease agreement with Webb County utilizing properties designated as school lands. Result: Secure competitive proposals for consideration and award by Commissioners Court for the benefit of Webb County and the School Districts that are located within Webb County boundaries.

23. Discussion and possible action to approve a lease agreement between Webb County and Enterprise Fleet Management (TIPS #2072816) for a 48-month term at an annual cost of $14,400.00 for two (2) vehicles to be assigned to the Indigent Health Department and in accordance with the Texas Local Government Code; Subchapter F. Cooperative Purchasing Program; Sections 271.101 & 271.102 and authorizing the County Judge to sign all relevant documents; and any other matters incident thereto. Solution: Commissioners Court approval is required to be placed on the lease program. Result: If approved, the department will have enough vehicles available to perform necessary day-to-day operations without interruption.

Discussion and possible action to authorize the Purchasing Agent to purchase all necessary law enforcement mobile radios for the previously approved leased police package vehicles in an amount not to exceed $500,000.00 from Motorola Solutions (State Cooperative Contract / HGAC # RAO 5-18) and in accordance with the Texas Local Government Code; Section 271.102 (Cooperative Purchasing Program Participation) [Account #1001-1130-001-470000 (Capital Outlay)]

25. Discussion and possible action to allocate additional funding for Las Lomas Drainage Project in the amount of $150,000 to proceed with the project for the next one hundred and twenty (120) days. The requested funds will cover all concrete needed and the guardrail for culvert 4. [Account #3875-7230-001-474501 (Bond Series)] Issue: The funding for this project is almost depleted. Solution: To transfer funds in to the account for Las Lomas drainage project. Result: To allow the Road & Bridge Dept. to continue working for the next four months.

Discussion and possible action to authorize a Clean-up Campaign for the communities of Las Lomas at 387 Sal Sipuedes, Centenarios and Las Pilas on April 7, 2020 from 8:00 am to 4:00 pm and on April 8, 2020 from 8:00 am to 8:00 pm; and authorize the utilization of Road & Bridge Department’s manpower and equipment; and any other matters incident thereto.

Discussion and possible action to authorize the purchase of seventeen (17) sets of bleachers at a cost of $2,000.00 per set and to not exceed a total purchase price of $34,000.00 from the Laredo Independent School District and in accordance with the Texas Government Code; Section 262.024 (Discretionary Exemptions)(7)(C.) by a political subdivision of the State and any other matters incident thereto. [Account #1001-1130-001-431007-010 (Operational Reserve)] Issue: The Laredo Independent School District no longer has a need for the bleachers. Each set can accommodate up to 120-140 people. The District currently has 17 bleacher sets available for sale. Solution: Approve a discretionary exemption to the competitive bidding requirements of the State that require expenditures exceeding $50,000.00 between two (2) political subdivisions of the State. Although the expense will not exceed $50,000.00, the Court is requesting for the discretional exemption to be passed for transparency purposes. Result: Webb County will secure the property for future use at the Fairgrounds and other County events where it will be beneficial for public use.

Discussion and possible action to authorize the Purchasing Agent to solicit Request for Qualifications for Architectural / Engineering Services to act as Owner’s Representative in overseeing the process of construction and renovations to the Webb County Fairgrounds project. The Owners Representative primary role is to represent the interest of Owner (Webb County) in regards to and not limited to ensuring that the quality of both materials and workmanship are in accordance with design and construction plans and specifications as approved by Owner and to further serve as the Owner’s eyes and ears independent from the Design Team and Construction Manager at Risk Contractor throughout the design, construction and completion of this project and any other matters incident thereto. [2020 Bond Series – Webb County Fairgrounds] Issue: The Webb County Fairgrounds project is estimated to cost $45 million to include new construction and renovations to existing facilities. The Court is requesting an independent contractor to oversee the process from beginning to end and provide frequent reports and recommendations as the project develops. The Owners representative will provide oversight and report on any recommendations, discrepancies and progress of design, construction and all other components of the construction such as compliance and project estimates being recommended by general contractor and design team to reach a guaranteed maximum price. Solution: Authorize the Purchasing Agent to seek RFQ for Owners Representative from qualified Architectural or Engineering firms that have substantial experience providing construction management services for project scopes of this magnitude. Result: Secure RFQ proposals for Courts consideration in selecting a qualified Owners Representative independent of the Design Team and Construction Manager at Risk.

Discussion and possible action to authorize the Purchasing Agent to purchase all necessary law enforcement equipment for the previously approved leased police package vehicles in an amount not to exceed $1,700,000.00 from Silsbee Ford, Inc. (State Cooperative Contract / Good-Buy #20 8F000) and in accordance with the Texas Local Government Code; Section 271.102 (Cooperative Purchasing Program Participation). 22. Discussion and possible action to authorize the Purchasing Agent to solicit Request for Proposals for Leasing of Webb County School Lands for Renewable Energy Development and any other matters incident thereto. Issue: Webb County currently leases property designated at school lands for Grazing and Hunting operations. Webb County and the School Districts are interested in using the same properties for renewable energy development utilizing wind, solar or both to generate renewable energy/electricity. This project can potentially generate substantial revenue for the benefit of the school districts and for Webb County. Solution: Approve the authorization to solicit for competitive proposals from Wind and Solar Energy firms interested in investing in a long-term lease agreement with Webb County utilizing properties designated as school lands. Result: Secure competitive proposals for consideration and award by Commissioners Court for the benefit of Webb County and the School Districts that are located within Webb County boundaries.

Discussion and possible action to approve a lease agreement between Webb County and Enterprise Fleet Management (TIPS #2072816) for a 48-month term at an annual cost of $14,400.00 for two (2) vehicles to be assigned to the Indigent Health Department and in accordance with the Texas Local Government Code; Subchapter F. Although the expense will not exceed $50,000.00, the Court is requesting for the discretional exemption to be passed for transparency purposes.
