Greg Abbott utilized Section 418.016 of the Government Code to suspend certain requirements of the Texas Open Meetings Act (TOMA) in light of the ongoing COVID-19 emergency. Tex. Gov't. Code Ann. Section 418.016 (Vernon 2017). The Governor suspended provisions of TOMA that require a quorum of the governing body and the general public to be together in a single location in order to allow videoconference or telephonic meetings. Discussion and possible action to authorize the Purchasing Agent to solicit competitive bids for the Webb County Colorado Acres RO Treatment Plant Renovation Project as required by the Texas Government Code, Sub-Chapter C. (Competitive Bidding Method), Section 2269.101 and any other matters incident thereto. [2019-A Bond Series #3869-7230-001-474501-030] Issue: Project was submitted directly by the Water Utilities Department and it was tabled twice by Commissioners Court. Project requires formal competitive bids and authorization from the Court to proceed with publication of invitation to bid. Solution: Authorize the Purchasing Agent to solicit for competitive bids and secure construction documents from a professional engineer with expertise and experience working with municipalities and counties in the renovation of water treatment plants similar to the scope of services required for this project. Result: The Purchasing Agent will seek Invitation for Bids for this project and present lowest responsible bidder to Commissioners Court at a future date for consideration of award.

Discussion and possible action to authorize the Purchasing Agent to solicit Requests for Qualifications (RFQ) for Engineering Services for the Webb County Colorado Acres RO Treatment Plant Renovation Project as required by the Texas Government Code, Chapter 2254 (Professional and Consulting Services), Section 2254.001 (Professional Services Procurement Act) and any other matters incident thereto. [2019-A Bond Series 3869-7230-001-474501-030] Issue: Project was submitted directly by the Water Utilities Department and was previously tabled twice by Commissioners Court. Project requires formal RFQ for engineering services to prepare the construction documents required for this project to be awarded by competitive bidding. Solution: Authorize the Purchasing Agent to solicit professional engineers with expertise and experience working with municipalities and counties in the renovation of water treatment plants similar to the scope of services required for this project. Result: The Purchasing Agent will seek RFQ as per State law and present highest ranking firms at a future date for Commissioners Court’s consideration to award.
