Greg Abbott utilized Section 418.016 of the Government Code to suspend certain requirements of the Texas Open Meetings Act (TOMA) in light of the ongoing COVID-19 emergency. Tex. Gov't. Code Ann. Section 418.016 (Vernon 2017). The Governor suspended provisions of TOMA that require a quorum of the governing body and the general public to be together in a single location in order to allow videoconference or telephonic meetings. 4. Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.

CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners. Discussion and possible action to allow purchasing agent to enter into an agreement between Ez Go Division of Textron Inc.(Buy Board #611-20) and Webb County for a forty-eight (48) month term for the lease of 80 new golf carts not to exceed $137.00 per month per cart for eighty carts for the use at Casa Blanca Golf course and in accordance with Texas local government code Sub Chapter F Cooperate Purchase programs; Section 271.101 and 270.102.; and further authorize a line item transfer from Account #1001-1130-001-431007-010 (Operational Reserve) for the difference to finish out the 2020-2021 Fiscal Year; and authorize the County Judge to sign and execute the lease agreement and any other matters incident thereto. [Account #7100-9050-001-483003-235 (Casa Blanca Golf Course Debt Service Payments - Administration - Capital Lease)] Issue: The golf course is experiencing higher volume in rounds and in need for more golf carts. Currently, there are 48 carts on hand and of those only 42 are in operation dn 6 are on repair status. We have the need and opportunity to replace the entire fleet of golf carts with 80 new ones with new fleet. Solution: Authorize the execution of a 48-month operating agreement under state cooperative contract which has met all cooperative bidding requirements of the State of Texas Result: The golf course will have enough carts to facilitate the growth and demand of increased rounds of golf at Casa Blanca and to better serve our community with larger tournament quantities.

24. Status report on delinquent tax collection by Webb County Tax Attorney Javier Montemayor, Jr. with discussion and possible action on the extension of delinquent tax contract or authorize the Purchasing Agent to solicit Request for Qualifications (RFQ’s); and any other matters incident thereto.

Discussion and possible action to approve the release of the withheld partial retainage payment in the amount of $12,116.87 from the original invoice amount of $242,313.00 payable to Schindler Elevator Corporation Invoice #7401514588 and authorize the County Judge to execute all relevant documents; and any other matters incident thereto. [Account #3868-7230-001-443000-255 Repairs & Maintenance Justice Center, Account #3868-206000-Retainage Payable] Issue: Elevator improvement was completed as detailed under contract specifications. Solution: Commissioners Court authorizes the release of retainer fee for the modernization of the Justice Center elevators. Result: Schindler Elevator Corporation will be paid for services rendered.

Status report on Request for Proposal (RFP) No. 2021-001 Wind/Solar Energy Project – Webb County School Lands with discussion and possible action to schedule sole proposer Gransolar for public interview and presentation of company’s qualifications and prior work experience with wind and/or solar energy projects and any other matters incident thereto. Issue: Only one proposal was submitted for formal invitation to RFP named above. Solution: Request direction from Commissioners Court on what action is being requested next for this formal solicitation. Consideration to interview sole proposer company at a future meeting, reject proposal and resolicit or any other action that is in the best interest for Webb County. Result: Move forward with the direction / action of Commissioners Court as approved during the February 8, 2021 regular meeting.

11. Risk Management

31. Discussion and possible action to approve a professional service agreement between Nuestra Salud Health Clinic (NSHC) and Webb County for general medical services for Webb County Employees and dependents enrolled in the employee health plan basic medical services at a fixed cost of One Hundred Dollars per hour not to exceed twenty hours per week and grant a discretionary exemption by order under the Texas Local Government Code, Section 262.024 (Discretionary Exemptions) (A.) (4) Personal or Professional Services and to further authorize the Civil Legal Department to negotiate the legal terms and conditions of this agreement; and any other matters incident thereto. Subject to available funds under Health Account; these funds were provided to the County through the Wellness and Clinical Operational Support category and therefore, will have no impact on the General Fund. [Account #6100-1090-001-452-010 (Claims Paid Medical)] Issue: To establish a pilot program delivering basic medical services to employees and their dependents with no co-pay nor claims filed on our insurance plan. Solution: The entering of the agreement will establish the foundation for continued basic medical services to employees and their dependents with no out-of-pocket cost to the employee. Result: The integration of medical services with a wellness program to promote employee engagement in maintaining good health.
