1. CALL TO ORDER BY THE HONORABLE TANO E. TIJERINA, WEBB COUNTY JUDGE

3. Discussion and possible action for Approval of Bills, Payroll, and Monthly Reports (Auditor, Treasurer, Business Office, Emergency Management, Human Resources, Risk Management, Tax Assessor-Collector; and any other Department reports); and any other matters incident thereto.

4. Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.

CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners. The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court. Presentation by Mr. Gerald Schwebel, Executive Vice President – IBC Bank, to share the Common Sense Border Management Solutions booklet, which is an update to Dennis Nixon’s 2017 document on a roadmap for finding common sense solutions to the many challenges facing the U.S. and Mexico border. 5. Casa Blanca Golf Course

20. Discussion and possible action to select a procurement delivery method(s) as permitted by Texas State Statutes to design and construct an exterior covered Patio and outdoor serving area to the Webb County Casa Blanca Golf Course Clubhouse area and any other matters incident thereto. [Account #1001-1130-001-431007-010 (Operational Reserve)] Issue: The Webb County Golf course outdoor patio requires structural improvements and upgrades to include an outdoor covered patio for scheduled events. Solution: Seek direction from the Court on selection of procurement delivery method. Result: Proceed with any action taken by the Court on this project for the Webb County Casa Blanca Golf Course.

21. Presentation with a 3-year budgetary update to Commissioners Court by Mr. Oscar Urdiales, General Manager – Casa Blanca Golf Course, to include ongoing projects at the golf course and upcoming plans and projects for the Court’s consideration, and any other matters incident thereto.

6. Economic Development

22. Discussion and possible action to approve and adopt the American Rescue Plan Act State and Local Fiscal Recovery Funds Webb County Sub Award Policies and Procedures and to designate an amount for funding, as recommenced by the ARPA Review Committee; authorizing the County Judge to sign all relevant documents; and any other matters incident thereto. Issue: In order to move forward with Sub Awards, policies and procedures must be adopted by Commissioner's Court. Solution: To approve and adopt American Rescue Plan Act State and Local Fiscal Recovery Funds Webb County Sub Award Policies and Procedures. Result: The ARPA Review Committee may begin moving forward with developing sub award process and solicitation.

7. Civil Legal Division

23. Discussion and possible action to approve and grant a ten year (10 yr.) Pipeline Right-of-Way Easement lease extension and renewal agreement and acceptance of the renewal fee check from Meritage Midstream Services, LLC., commencing September 27, 2021 thru September 26, 2031 at the original easement rate of $15.00 per foot per year plus the additional 2021 ten year (10 yr.) CPI rental rate increases as per the lease terms, and authorizing the Webb County Judge to execute any and all relevant documents; and any other matters incident thereto.

24. Discussion and possible action to approve a professional services contract with Javier Pena to provide specialized training for law enforcement personnel and other law enforcement services for a performance period of eleven (11) months at a cost of One Thousand Five Hundred Dollars ($1,500.00) per month, effective November 1, 2021, through September 30, 2022, for an amount not to exceed Sixteen Thousand Five Hundred Dollars ($16,500.00). No impact to the General Fund. [Requested by Martin Cuellar, Sheriff; Account #2152-3010-001-432001 (Professional Services- Forfeiture Funds)] Issue: Webb County Sheriff requests specialized law enforcement training and other law enforcement services. Solution: Contract services to assist with specialized training for members of the Sheriff's Office. Result: Secure recommendations on standard operating procedures, specialized training, and any other matters that pertain to the mission and goals of the Webb County Sheriff’s Office as directed and approved by the Webb County Sheriff.

25. Discussion and possible action to enter into a consulting agreement with Willdan Financial Services to prepare a water and wastewater rate study and long-term financial plan in an amount not to exceed Thirty-One Thousand Eight Hundred Eighty Dollars ($31,880) and any other matters incident thereto; authorizing the County Judge to sign all relevant documents. [Account #1001-1130-001-432001 (General Fund-General Operating Expenses-Administration Professional Services)]

Discussion and possible action to enter into a professional services agreement with Cascos and Associates, PC to audit the financial statements of Webb County for the fiscal years ending September 30 of 2021, 2022 and 2023 in an amount not to exceed Sixty Seven Thousand Five Hundred Dollars ($67,500) per fiscal year and any matters incident thereto; authorizing the County Judge to sign all relevant documents. Discussion and possible action to rescind the award of an engineering services contract for the Wastewater Treatment Plant Upgrades (RFQ 2021-008) to Energy Systems Group LLC (awarded September 13, 2021) and to rank the four remaining engineering firms and award an engineering services contract for the Wastewater Treatment Plant Upgrades to the top ranked firm and any matters incident thereto. [Fund #2703 American Rescue Plan Act]

Discussion and possible action to retain the legal services of Blakely Fernandez, Bracewell LLP to assist in finalizing agreements and related documents for County participation in City of Laredo TIRZ #2. [Funding from reimbursement on TIRZ administrative fees if qualified or from Account #1001-1130-001-432001 (General Fund-General Operating Expenses-Administration Professional Services)]

Discussion and possible action to approve the following budget amendment, effective September 30, 2021 in order to cover expenses that were not covered by the FEMA (Fund 2470) grant in the amount of $22,753.48 for expenses incurred for Fiscal Year 2020-2021; and any other maters incident thereto [Account #1001-1130-001431007-010 (Operational Reserve)] Issue: Fund 2470 was created to cover COVID-19 related expenses during the global pandemic. These funds were not covered by the grant. Solution: Transfer will be allocated from the Operational Reserve Account. Result: Fund will close out for the remaining of the fiscal year.

31. Discussion and possible action to adopt, by Order, a Redistricting Plan and reapportionment of the Webb County Commissioner Precincts as necessary to maintain a substantially equal population (generally, containing less than 10% deviation between least and most populated precincts) arising from the results of the 2020 census and authorization for the County Judge to execute all required documents; directives to the County Clerk, Elections Administrator and staff to publish required notices in the newspaper and the county’s official website; and ordering the submission of all required certified copies to the Texas Secretary of State in compliance with state law and the provisions of SB 13 (87th Leg., 2d C.S.) for the 2022 election cycle due to delays in the U.S. Census Bureau releasing 2020 Census data.

32. Discussion and possible action on changes and/or additions to County Election Precincts (voting tabulation districts, "VTD"s) to give effect to any redistricting changes which ensures that each election precinct does not contain territory from more than one commissioners' precinct, justice precinct, congressional district, state representative district, state senatorial district, or State Board of Education district (§42.005, Election Code) and to increase or reduce the number of registered voters within election precincts to meet population requirements (§42.006, Election Code).

11. Pre-Trial Services

33. Discussion and possible action to approve the 2022 Formula Grant Indigent Defense Resolution. The purpose of the grant is to develop and maintain quality, cost-effective defense system that meets the needs of local communities and the requirements of the constitution and state law. Webb County will be eligible to receive a portion of the funding. This is a yearly on-going grant resolution. There will be no impact to the general fund.

The Marine Corp distributes toys to the less fortunate children across the country in hopes to make the holidays brighter for many families.
