3. Discussion and possible action for Approval of Bills, Payroll, and Monthly Reports (Auditor, Treasurer, Human Resources, Risk Management; and any other Department reports); and any other matters incident thereto.
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners. The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court. The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda. 5. Human Resources
20. Discussion and possible action to amend the Personnel Policy, section 6.25 Wage Overpayment / Underpayment Policy and any other matters incident thereto. Issue: Legal is recommending policy for wage overpayment/underpayment in an effort to address to ensure that employees receive the correct amount of compensation. Solution: Approval of this policy will define steps to address issues of overpayment and underpayment of County employee’s compensation. Result: County staff will have direction in addressing overpayment/underpayment issues.
21. Discussion and possible action to appoint/re-appoint the Civil Service Commissioners, for a Two – year term, commencing January 1, 2023 – December 31, 2025, and any other matters incident thereto. Issue: Term will expire for the current Commissioners, Roberto Santos, and Edward C. Sherwood and Rodolfo Morales. Solution: In order for the Civil Service Commissioners to conduct business, a quorum is required. Result: The appointment or re-appointment of the commissioners will insure smooth and efficiently run commission, and will provide good continuity for such an important function.
6. Building Maintenance
22. Discussion and possible action to approve the release of the withheld partial retainage payment in the amount of $10,763.19 from the original invoice amount of $215,264.00 payable to Schindler Elevator Corporation Invoice #7401566036 and authorize the County Judge to execute all relevant documents; and any other matters incident thereto. [Account #3868-7230-001-443000-260 (Repairs & Maintenance Administration Building) and Account #3868-206000 (Retainage Payable)] Issue: Elevator improvement was completed as detailed under contract specifications. Solution: Commissioners Court authorizes the release of retainer fee for the modernization of the Administration Building elevators. Result: Schindler Elevator Corporation will be paid for services rendered.

Discussion and possible action to accept the rankings and award Request for Qualifications RFQ 2023-001 “Southern Public Health Center - Architectural Services” to the highest-ranking respondent, Redline Architecture, LLC for the design, preparation of construction documents and construction administration of a Public Health Center in Southern Webb County to provide health services to low and moderate income residents of Rio Bravo, El Cenizo, and La Presa Communities in accordance with Texas Government Code – Professional Services Procurement Act and if applicable with the Code of Federal Regulations §200.318 - §200.327 (General Procurement Standards) and to further authorize General Counsel to negotiate the terms and conditions of the professional service agreement and any other matters incident thereto. Discussion and possible action to accept the rankings and award Request for Qualifications RFQ 2022-015 “Environmental Services for County Projects” to the top three (3) highest-ranking proposers on a rotational and as needed basis for various County projects for a three (3) year performance period in accordance with Texas Government Code – Professional Services Procurement Act and to further authorize General Counsel to negotiate the terms and conditions of the professional service agreement and any other matters incident thereto. Result: If awarded to recommended firms, professional service agreements will be brought back to Commissioner Court on a project to project basis when services are required during the performance period.

Discussion and possible action to approve the purchase of three (3) Bennett 3000 Series Dual Sided Fuel Dispensers to include installation from C-Store Technologies, Inc. for a total not to exceed $36,892.00 and to further authorize the transfer of funds from the General Fund Operational Reserve Account #1001-1130-001-431007-010 to the General Fund/Vehicle Maintenance Capital Outlay Account #1001-1120-001-470000 and any other matters incident thereto. [Account #1001-1120-001-470000 (General Fund-Vehicle Maintenance-Administration-Capital Outlay)] Issue: Road and Bridge Department/Motor Pool is recommending upgrading the existing three (3) dual sided fuel dispensers for diesel and unleaded fuel that are over ten (10) years old. Solution: Consideration to approve the purchase of new dual sided fuel dispensers for Motor Pool division. Three (3) informal quotes were submitted. C-Store Technologies provided the low bid and compatibility to fuel dispensing software (Mega-Tronics). Result: If approved, the dispensers will be ordered after transfer of funds is initiated.

Discussion and possible action to approve the purchase of one (1) Mega-Track MCU Series software and equipment to include factory start-up/initial on-site installation and training from Mega-Tronics International Corp. (Buy-Board Contract #590-19) for a total not to exceed $30,211.00 in accordance with the Texas Local Government Code; Sections 271.101, 271.102, Sub-Chapter F. Cooperative Purchasing Programs; and to further authorize the transfer of funds from the General Fund Operational Reserve Account #1001-1130-001-431007-010 to the General Fund/Vehicle Maintenance Capital Outlay Account #1001-1120-001-470000 and any other matters incident thereto. [Account #1001-1120-001-470000 (General Fund-Vehicle Maintenance-Administration-Capital Outlay)] Issue: Road and Bridge Department/Motor Pool is recommending upgrading the existing fuel dispensing software, it will be compatible with the new fuel dispensers being purchased. Current software is outdated and upgrading will provide better compatibility with new fuel dispensers and other equipment being replaced in order to dispense fuel for County operations. Solution: Consideration to approve the purchase of required software, site installation, training and related expenses. Result: If approved, order software and equipment needed for motor pool operation.

Discussion and possible action to support, by Resolution, the intent to coordinate with Legacy Water Supply Corporation to secure water for Webb County and its colonias and express the intent to coordinate in obtaining grants, low-interest loans, and other financing opportunities from local, state, federal and other private and public funding resources; and any other matters incident thereto.

Discussion and possible action to approve, by Order, the approval and execution of a memorandum of agreement to proceed with due diligence on Legacy Water Supply Corporation’s proposal to further examine and to cooperate in bringing a secondary water supply to Webb County and its underserved colonias; and any other matters incident thereto.

Discussion and possible action to approve, by Order, delegating regulatory authority with regard to floodplain and drainage prevention from Webb County to the Legacy Water Control and Improvement District, or its successive entity, for properties or projects located within the boundaries of said District; and any other matters incident thereto.
