CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners. The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court. 17. Discussion and possible action to approve, by Order, the following budget amendment (line item transfers) within Forfeiture funds: Acct. Number Acct. 18. Discussion and possible action to amend Personnel Policy 2.11 Hiring Process and 5.07 Employee Conduct Violations, as recommended by the County Policy Committee and any other matters incident thereto.
7. Civil Legal Division
19. Discussion and possible action to authorize Raba Kistner Consultants, Inc. to proceed with Phase II – Design and Construction Phase Services (fees will be based on 6.75% of construction cost for the Webb County Justice Center Roof Project as per the Professional Services Contract dated August 23, 2022) and any other matters incident thereto; authorizing the County Judge to sign all relevant documents. Issue: After many years the Justice Center has developed leaks in the roof which causes offices and courtrooms to have water damage anytime there is a substantial rain event. In August of 2022 the Court entered a contract which provided for an assessment of the roofs condition, recommendations regarding repair/replacement (Phase 1) and for design and construction administration services (Phase 2). The assessment has been completed and reveals substantial repair and replacement of the building’s roof is necessary and the probable cost estimated by the Consultant is $4,403,000. The fees for the Consultant are based on construction contract on a sliding scale, the estimate of probable cost indicates the fee would likely be based on 6.75% of construction cost. Solution: Authorize the Consultant to proceed so the Project can be designed and bid. Result: Consultant can immediately begin designing construction plans for bid.
20. Discussion and possible action to enter into an equipment procurement and installation agreement with Audio Dynamics, Inc. to upgrade the Webb County Jail Security Camera System in an amount not to exceed ONE HUNDRED TWENTY-SEVEN THOUSAND SEVEN HUNDRED SEVENTEEN DOLLARS ($127,717.00), authorizing the Webb County Judge to execute all relevant documents and any matters incident thereto. [Account #1001-4070-001-470000-001 (General Fund-Sheriff Jail Administration Outlay)] Issue: The Webb County Jail is in need of an upgrade to its Surveillance Camera System. Solution: Enter into an Agreement with Audio Dynamics, Inc., who was the highest ranked proposer, to undertake Jail Security Camera Upgrades. Result: Security Camera upgrades will assist in increasing the security at the Jail.
21. Discussion and possible action to enter into a retainer agreement Winstead PC and J. Cruz & Associates, LLC regarding a public-private partnership for the development of an international bridge in Webb County and any matters incident thereto; authorizing the County Judge to sign all relevant documents. [Account #1001-1130-001-432001 (General Fund-Professional Services)]

Discussion and possible action to consider the offer of Forty-Two Thousand Six Hundred Thirty Dollars ($42,630.00) made by the State of Texas to purchase easement rights (250 feet) across property (a 2.4102 acre unplatted tract of land along the Rio Grande River in the Rio Bravo Annex Subdivision) owned jointly by Webb County and the United Independent School District (acting as trustee) to facilitate the construction of a Texas Barrier Infrastructure System along the Rio Grande River and any matters incident thereto; authorizing the County Judge to sign all relevant documents.
23. Discussion and possible action to issue a letter of support in accordance with 25 TAC 157.11 to Acute Specialty Transport with notice to the Costal Bend Regional Advisor Counsel that Acute Special Transport is approved to operate in Webb County, Texas. Issue: Coastal Bend has their offices in Webb County and advises they will be providing service on a State contract and statewide basis and will not be providing service in Webb County unless directed to by the State during an emergency. Solution: Issue a Letter of Support and Approve Acute Specialty Transport to operate in Webb County, Texas. Result: Will have additional EMS services in Webb County, Texas.
8. Engineer
24. Discussion and possible action to approve Change Order No. 1 to Howland Engineering and Surveying Co., for additional construction material testing (Box Culverts) in the amount of $3,400.00 for the Webb County Welch Road Project; and have the County Judge sign any relevant documents; and any other matters incident thereto. [Account #2007-7150-001-432001 (Professional Services)] Issue: We currently have exceeded the contract amount of $5,305.00 (Purchase Order 2023-00001293). This project required additional concrete sampling for the concrete culverts proposed for the project. Based on our observations, the concrete culverts were initially to be pre-cast as opposed to cast-in-place. Due to the aforementioned, concrete samples were taken for every day's pour. Additionally, extra density tests were taken within the backfill for the box culverts and the roadway improvements. Based on current progress with this project, we are still in need of performing additional tests. Howland has updated the CMT (Construction Material Testing) quantities with the cast in place culvert concrete cylinders along with additional density and asphalt tests. Solution: Approval of the new proposed changes in order to finish and close this road project. This project is an in-kind project with the Texas Department of Transportation (TxDOT) for future projects. Result: Approval of change order will continue and finish with project modifications.
25. Discussion and possible action to approve Change Order No. 2 for SAL Construction Management for the County Transportation Infrastructure Fund (CTIF) Wormser Road Project. There will be no monetary change to the contract only the addition of Sixty (60) days to the contract; and have the County Judge sign any relevant documents; and any matters incident thereto. [No Impact to General fund] Issue: Days are needed to complete items previously approved in Commissioner Court dated April 11, 2023 (Agenda Item No. 17) which Project Engineer, Sherfey Engineering has just finished designing, as per the Texas Department of Transportation and the City of Laredo. Solution: Approval of change order to finish and close out this road project. Result: Approval of change order will continue and finish with project modifications.
9. Purchasing
26. Discussion and possible action to authorize the purchase of three (3) APX6500 Enhanced VHF Mobile Radios from Motorola Solutions, Inc. (HGAC Contract #RA05-21) for the Webb County Constable Pct. 1 Office pursuant to §271.101 and §271.102, Texas Local Government Code, Cooperative Purchasing Program in an amount not to exceed $20,017.05 and to further authorize the transfer of funds from the general operating reserve account (1001-1130-001-431007-010) to Constable Pct. 1 Capital Outlay account (1001-3150-001-470000) in the amount not to exceed $20,018.00 and any other matters incident thereto. [Account #1001-3150-001-470000 (General Fund - Constable Pct. 1 - Administration-Capital Outlay)] Issue: On Monday, May 08, 2023, Commissioners Court approved the lease agreement for three (3) Ford Police Interceptors (Explorers). APX Mobile Radios were not included in the initial after-market costs. These radios are purchased separately from Motorola and delivered to outfitter for installation. Solution: Purchase APX 6500 mobile radios for law enforcement use, this model is same equipment ordered for all other police units assigned to Webb County law enforcement agencies. Installation will be done by CAP Fleet. Result: New police package vehicles ordered will include the required mobile radios for law enforcement purposes.
27. Discussion and possible action to accept the rankings and award the equipment portion of RFP 2023-007 ARPA Project No. 16 "Webb County Courthouse Video and Audio Equipment" to the highest ranking company BIS Digital in accordance with the Texas Procurement Laws and with the Code of Federal Regulations §200.318 - §200.327 (General Procurement Standards) and to further authorize General Counsel to execute the contract for the awarded sum in an amount not to exceed $180,894.69 to include optional annual support plans as listed below if approved by Commissioners Court and any other matters incident thereto. Project is being funded by the American Rescue Plan Act, State and Local Fiscal Recovery funds. Solution: Consider approving the award to the highest ranking respondent for the equipment portion of this formal solicitation. Streaming services will be recommended to another vendor at the next regular court meeting. Result: If approved, authorize General Counsel to execute the contract for awarded sum and optional support plans, if selected to include any federal provisions required, when applicable.
28. Discussion and possible action to authorize the Purchasing Agent to advertise an Invitation to Bid for the removal of existing carpet and replacement with new carpet or tile for the 49th District Court, 111th District Court, 341st District Court, and 406th District Court in accordance with the Texas County Purchasing Act and any other matters incident thereto. Issue: Carpet replacement is needed for various county offices, projected cost will exceed the $50,000.00 ceiling. Solution: Authorize the Purchasing Agent to secure formal bid proposals to obtain the best price for requested services. Result: An Invitation to Bid will be posted to provide interested vendors an opportunity to bid on project in order to obtain competitive pricing.
10. Risk Management
29. Discussion and possible action to proclaim the month of June 2023 as National Safety Month by the Webb County Commissioners Court, and encourage all employees to participate in practicing safe and healthy behaviors in all aspects of their lives. As part of this month’s safety development efforts, the introduction of the “Good Catch” initiative is set to be launched this June for County employees. [Requested by Safety Committee]
11. Honorable Patricia Barrera, Tax-Assessor- Collector
30. Discussion and possible action to authorize the Purchasing Agent to solicit Requests for Proposals (RFP) for construction/remodeling work needed in the Tax Assessor-Collector's Office; and any other matters incident thereto. Issue: The Tax Office layout currently lacks in functionality and makes it more difficult to conduct the many duties of the Tax Office. Solution: Secure the services of a professional contractor to allow for some spaces within the office to be modified for better functionality. Result: Office space and layout will be more conducive for daily activity and customer service.
12. Commissioners Court Administrator PUBLIC HEARING
31. Public Hearing on establishing a reinvestment zone, to be known as the Hecate Energy Outpost Solar Reinvestment Zone, located approximately 24 miles from Laredo in North Eastern Webb County east of Interstate 35. CLOSE PUBLIC HEARING
32. Discussion and possible action to establish, by Order of the Webb County Commissioners Court, a reinvestment zone to be known as the Hecate Energy Outpost Solar Reinvestment Zone, located approximately 24 miles from Laredo in North Eastern Webb County east of Interstate 35; directing a proposed Tax Abatement agreement be prepared; authorizing the publication of all required notices as per statute and any other matters incident thereto.
33. Discussion and possible action to retain the services of SledgeLaw Group PLLC to provide counsel to Webb County on the groundwater availability numbers established for Webb County; on working with the Groundwater Management Area 13; and on monitoring the progress of pending legislation regarding creation of groundwater conservation in the County; authorizing the County Judge to sign all relevant documents. Issue: Current contract for Financial Advisor services expires on August 29, 2023. Adequate time will be needed to solicit services and choose a qualified firm. Solution: Placing an item for RFQ’s will allow sufficient time to select a qualified firm. Result: Qualified firm will be selected prior or at the time of current contract expiration.

Issue: Coastal Bend has their offices in Webb County and advises they will be providing service on a State contract and statewide basis and will not be providing service in Webb County unless directed to by the State during an emergency. Solution: Issue a Letter of Support and Approve Acute Specialty Transport to operate in Webb County, Texas. Result: Will have additional EMS services in Webb County, Texas.
8. Engineer
24. Discussion and possible action to approve Change Order No. 1 to Howland Engineering and Surveying Co., for additional construction material testing (Box Culverts) in the amount of $3,400.00 for the Webb County Welch Road Project; and have the County Judge sign any relevant documents; and any other matters incident thereto. [Account #2007-7150-001-432001 (Professional Services)] Issue: We currently have exceeded the contract amount of $5,305.00 (Purchase Order 2023-00001293). This project required additional concrete sampling for the concrete culverts proposed for the project. Based on our observations, the concrete culverts were initially to be pre-cast as opposed to cast-in-place. Due to the aforementioned, concrete samples were taken for every day's pour. Additionally, extra density tests were taken within the backfill for the box culverts and the roadway improvements. Based on current progress with this project, we are still in need of performing additional tests. Howland has updated the CMT (Construction Material Testing) quantities with the cast in place culvert concrete cylinders along with additional density and asphalt tests. Solution: Approval of the new proposed changes in order to finish and close this road project. This project is an in-kind project with the Texas Department of Transportation (TxDOT) for future projects. Result: Approval of change order will continue and finish with project modifications.
25. Discussion and possible action to approve Change Order No. 2 for SAL Construction Management for the County Transportation Infrastructure Fund (CTIF) Wormser Road Project. There will be no monetary change to the contract only the addition of Sixty (60) days to the contract; and have the County Judge sign any relevant documents; and any matters incident thereto. [No Impact to General fund] Issue: Days are needed to complete items previously approved in Commissioner Court dated April 11, 2023 (Agenda Item No. 17) which Project Engineer, Sherfey Engineering has just finished designing, as per the Texas Department of Transportation and the City of Laredo. Solution: Approval of change order to finish and close out this road project. Result: Approval of change order will continue and finish with project modifications.
9. Purchasing
26. Discussion and possible action to authorize the purchase of three (3) APX6500 Enhanced VHF Mobile Radios from Motorola Solutions, Inc. (HGAC Contract #RA05-21) for the Webb County Constable Pct. 1 Office pursuant to §271.101 and §271.102, Texas Local Government Code, Cooperative Purchasing Program in an amount not to exceed $20,017.05 and to further authorize the transfer of funds from the general operating reserve account (1001-1130-001-431007-010) to Constable Pct. 1 Capital Outlay account (1001-3150-001-470000) in the amount not to exceed $20,018.00 and any other matters incident thereto. [Account #1001-3150-001-470000 (General Fund - Constable Pct. 1 - Administration-Capital Outlay)] Issue: On Monday, May 08, 2023, Commissioners Court approved the lease agreement for three (3) Ford Police Interceptors (Explorers). APX Mobile Radios were not included in the initial after-market costs. These radios are purchased separately from Motorola and delivered to outfitter for installation. Solution: Purchase APX 6500 mobile radios for law enforcement use, this model is same equipment ordered for all other police units assigned to Webb County law enforcement agencies. Installation will be done by CAP Fleet. Result: New police package vehicles ordered will include the required mobile radios for law enforcement purposes.
27. Discussion and possible action to accept the rankings and award the equipment portion of RFP 2023-007 ARPA Project No. 16 "Webb County Courthouse Video and Audio Equipment" to the highest ranking company BIS Digital in accordance with the Texas Procurement Laws and with the Code of Federal Regulations §200.318 - §200.327 (General Procurement Standards) and to further authorize General Counsel to execute the contract for the awarded sum in an amount not to exceed $180,894.69 to include optional annual support plans as listed below if approved by Commissioners Court and any other matters incident thereto. Streaming services will be recommended to another vendor at the next regular court meeting. Result: If approved, authorize General Counsel to execute the contract for awarded sum and optional support plans, if selected to include any federal provisions required, when applicable.

Discussion and possible action to authorize the Purchasing Agent to advertise an Invitation to Bid for the removal of existing carpet and replacement with new carpet or tile for the 49th District Court, 111th District Court, 341st District Court, and 406th District Court in accordance with the Texas County Purchasing Act and any other matters incident thereto. Issue: Carpet replacement is needed for various county offices, projected cost will exceed the $50,000.00 ceiling. Solution: Authorize the Purchasing Agent to secure formal bid proposals to obtain the best price for requested services. Result: An Invitation to Bid will be posted to provide interested vendors an opportunity to bid on project in order to obtain competitive pricing.
10. Risk Management

Discussion and possible action to proclaim the month of June 2023 as National Safety Month by the Webb County Commissioners Court, and encourage all employees to participate in practicing safe and healthy behaviors in all aspects of their lives. As part of this month’s safety development efforts, the introduction of the “Good Catch” initiative is set to be launched this June for County employees. [Requested by Safety Committee]

30. Discussion and possible action to authorize the Purchasing Agent to solicit Requests for Proposals (RFP) for construction/remodeling work needed in the Tax Assessor-Collector's Office; and any other matters incident thereto. Issue: The Tax Office layout currently lacks in functionality and makes it more difficult to conduct the many duties of the Tax Office. Solution: Secure the services of a professional contractor to allow for some spaces within the office to be modified for better functionality. Result: Office space and layout will be more conducive for daily activity and customer service.
