3. Discussion and possible action for Approval of Bills, Payroll, and Monthly Reports (Auditor, Treasurer, Business Office, Human Resources, Judicial Collections, Risk Management, Tax Assessor-Collector; and any other Department reports); and any other matters incident thereto.
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners. The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court. The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. 15. Discussion and possible action to continue paying grant-funded personnel under OOG Grant #2466310 Region-2 Border Prosecution Unit Grant (Fund 2739), for (90) days, until notification about grant continuance award from the Criminal Justice Division by the Office of the Governor, Public Safety Office. All personnel costs will be reimbursed with grant funds. Issue: Current grant funding expires on August 31, 2023. The Border Prosecution Unit (BPU) Program has not received notice of award for the new grant. Unless this item is approved, personnel working under this grant will not be paid after August 31, 2023. Solution: Grant a 90-day payroll extension effective September 1, 2023 Result: The Webb County District Attorney’s Office will continue to employ the grant-funded personnel, and will continue to execute its duties against criminal activity.
16. Discussion and possible action to continue paying grant-funded personnel under OOG Grant #4373601 (Fund 2737) Border Prosecution Program – HB9 Operation Lone Star, (90) days, until notification about grant continuance award from the Criminal Justice Division by the Office of the Governor, Public Safety Office. All personnel costs will be reimbursed with grant funds. Issue: Current grant funding expires on August 31, 2023. The Border Prosecution Program – HB9 Operation Lone Star has not received notice of award for the new grant. Unless this item is approved, personnel working under this grant will not be paid after August 31, 2023. Solution: Grant a 90-day payroll extension effective September 1, 2023 Result: The Webb County District Attorney’s Office will continue to employ the grant-funded personnel, and will continue to execute its duties against criminal activity.

Discussion and possible action to continue paying grant-funded personnel under the Office of the Attorney General, Grant #C00071 Fund 2714 Victim Coordinator & Liaison (VCLG), for (90) days, until notification about grant continuance award from the Criminal Justice Division by the Office of the Attorney General. All personnel costs will be reimbursed with grant funds. Issue: Current grant funding expires on August 31, 2023. Victim Coordinator & Liason (VCLG) program, has not received notice of award for the new grant. Unless this item is approved, personnel working under this grant will not be paid after August 31, 2023. Solution: Grant a 90-day payroll extension effective September 1, 2023 Result: The Webb County District Attorney’s Office will continue to employ the grant-funded personnel, and will continue to execute its duties towards victim.
6. Honorable Martin Cuellar, Sheriff
18. Discussion and possible action to request the appropriate cash match from Webb County for the FY 2024 Webb County budget in order cover salary and fringe benefits cost expenditures to pay the two (2) current grant-funded HIDTA Task Force officers assigned to the City of Laredo Police Department Task Force at the appropriate wage scale in compliance with the contractual stipulations of the Webb County Collective Bargaining Agreement (CBA); and any other matters incident thereto. The HIDTA Task Force officers are members of the Collective Bargaining Agreement (CBA); and the Webb County Sheriff’s Office is requesting additional funding from Webb County in order to cover salary and fringe benefit cost expenditures in excess of the anticipated grant award for FY2024. The amount requested for the incoming fiscal year (FY 2024) is $69,518. Please see table below for specific breakdown of this $69,519 budget request. [Requested by Martin Cuellar, Webb County Sheriff; Account #1001-1160-463903-040] Payroll Cost $44,454 Health Life Insurance $5,005 FICA County Share $8,547 Retirement County Share $308 Unemployment Tax $1,368 Worker Compensation $9,836 $69,518 Issue: The HITDA grant (#2906) has allocated payroll and fringe benefits costs associated with the two (2) HITDA Officers at $25.21/ hour per officer, an amount less than the base wage assigned by the Collective Bargaining Agreement. Solution: Approval of the applicable payroll costs and fringe associated with the two (2) HITDA investigators assigned to the Laredo Police Department Task Force. Result: The Webb County Sheriff's Office will continue to employ two (2) HIDTA funded investigators who will actively participate and help the task force fight against the continued flow of illicit drugs and related crime within the South Texas region.
19. Discussion and possible action to approve the purchase of law enforcement uniforms from Galls. (Buy-Board Contract No. 670-22) for an amount not to exceed $116,577.60 for the Webb County Sheriff’s Office and in accordance with the Texas Local Government Code; Section 271.101 & 271.102 (Sub-Chapter F. Cooperative Purchasing Program) and any other matters incident thereto. [Accounts #1001-3010, 3050, 3190, 4070-001-456305 (Multiple Uniform Accounts)] Issue: The Webb County Sheriff’s Office needs to replace uniform items/ uniforms for collective bargaining members. Solution: Approve the use of the recommended vendor who also holds a cooperative contract Buy-Board No. 670-22 Result: Issue purchase order for the approved amount. Lead time is 30–45 days, but final deliveries will not exceed 10/31/2021.
Drug Court Program
20. Discussion and possible action to continue paying grant funded personnel under the Office of the Governor, Grant #4418101, FY23 Specialty Court Program, Ninety (90) days, until notification about grant continuation award from the Criminal Justice Division (CJD) by the Office of the Governor, Public Safety Office. All personnel costs will be reimbursed with grant funds. [Requested by Margarita Herrera-Garza, Drug Court; Account #2710-1020-001-410000 (Payroll)] Issue: Current Grant funding expires August 31, 2023. The Adult Drug Court Specialty Program has not received notice of award for the grant renewal, Grant No. 4448102. Solution: Grant a 90-day payroll extension for personnel working under the grant. Result: the Drug Court will continue to provide services without interruption.
8. Civil Legal Division
21. Discussion and possible action to enter into a Tax Abatement Agreement, pursuant to the County’s Guidelines And Criteria under the Property Redevelopment and Tax Abatement Act, Chapter 312 of the Texas Tax Code, as requested by Gransolar Texas Three, LLC, for approximately $184,000,000 in improvements related to generation of electricity using solar panels for a ten year period and being a 100% tax abatement of ad valorem taxes (maintenance and operation only), with Payments In Lieu of Taxes (PILOT payments) to be made annually to Webb County and any matters incident thereto, and authorizing the County Judge to sign all relevant documents. The property subject to the abatement agreement is located approximately 15 miles from Laredo in Southern Webb County off of US Highway 83 within the Gransolar Texas Tres Reinvestment Zone.
22. Discussion and possible action to grant a Right of Entry to SE LEGACY DEVELOPMENT, LLC and LTMM6 LAND COMPANY, LTD. for three months to enter onto Webb County property, being a 604.14 acre tract located along U.S. Hwy 83, for the purpose of conducting topographical and boundary surveys, engineering studies, planning feasibility studies, archeological and environmental inspections, mechanical vegetation clearing, geotechnical drilling and analysis, drainage and access and appraisals along a 50 foot wide by 5,753.79 foot long frontage strip of land and any matters incident thereto; authorizing the County Judge to sign all relevant documents. [Requested by SE Legacy Development, LLC and LTM6 Land Company, Ltd.]
23. Discussion and possible action to retain the law firm of Walsh, Gallegos, Trevino Kyle and Robison P.C. as legal counsel to advise, investigate, and review complex employment issues and authorizing the Webb County Judge to execute any and all relevant documents and any other matters incident thereto. [Requested by the Webb County Civil Legal Division, Account #001-1130-001-432001 (Professional Services)]
9. Elections
24. Discussion and possible action to approve a Resolution and Order of the Constitutional Amendments/Special Election and to authorize and establish the Early Voting Polling Locations and Election Day Sites for the November 7, 2023 Constitutional Amendment/ Special Election within Webb County, Texas pursuant to Chapter 85, Texas Election Code.
25. Discussion and possible action to approve a Resolution and Order authorizing a Joint Election between the County of Webb, the City of Rio Bravo, Legacy Municipal Management District, and the Webb County Municipal Utility District No.1 to be conducted on November 7, 2023 and authorize the Webb County Elections Administrator to prepare an election services contract for the conduct and supervision of said elections pursuant to Chapter 271, Texas Election Code.
10. Engineer
26. Discussion and possible action to approve the closeout and release of retainage in the amount of $16,976.25 to Romo Contractors LLC., for the Webb County Casa Blanca Golf Course Improvements Project; and authorize the County Judge sign any relevant documents; and any other matters incident thereto. [Account #7100-206000 (Retainage Payable)] Issue: This project has been completed. Contractor is requesting final pay (retainage amount). There will be a credit of $2,375.00 from the $16,000.00 Allowance which will be credited back to the original funding source. Solution: Approve and release retainage amount and close out project. Result: Completion of project and release of retainage.
27. Discussion and possible action to approve the closeout and release of retainage in the amount of $26,445.00 to Gilmar Construction LTD., for the Welch Road Culvert Improvement Project; and have the County Judge sign any relevant documents; and any other matters incident thereto. [Account #2703-206000 (Retainage Payable)] Issue: The Welch Road Culvert Improvement Project has been completed. Solution: Approval to close out and release retainage. Result: Project completion and safe road for Webb County constituents and First Responders.

Discussion and possible action to approve the transfer of funds in the amount of $15,848.59 from account #3907 (series 2020) for the Quad City Fire Station / JP Renovation Project: and have the County Judge sign any relevant documents and any other matters incident thereto. [Account #3902-7230-001-474501 (Construction in Progress)] Issue: Funds are needed for Material Testing previously approved in Commissioner Court dated July 10, 2023 (Agenda Item 26) for the Quad City Fire Station / JP Renovation Project. Solution: Approve agenda item for the transfer of funds. Result: Approval of transfer of funds in order for the project to proceed.
11. Purchasing
29. Discussion and possible action to award Request for Qualification (RFQ) No. 2023-014 "Self Help Center Architectural Services for Rehabilitation Projects - Economic Development Contract No. CFC-22-0089" to the sole respondent Slay Architecture, LLC, and to further authorize the Civil Legal Department to prepare a professional services contract and any other matters incident thereto. [Account #2532-6010-521-432001 (Colonia Fund TDA CFC22-0089-Economic Development-C.A.A.-Professional Services)] Issue: The Commissioners Court accepted a grant award from the Texas Department of Agriculture (TDA) on February 27, 2023, Item #11 (a) for housing rehabilitation in the amount of $985,000. The TDA grant will allow Webb County to provide rehabilitation to ten (10) homes under the Economic Development Department Contract #CFC-22-0089. Solution: Approve award to sole respondent to RFQ, Slay Architecture, LLC. Result: Proceed with preparation of a professional services contract with sole respondent for the design of plans and specifications, preparation of construction documents, preparation of bidding documents, construction oversight and construction inspections for the Webb County Colonia Fund Construction Housing Rehabilitation Grant.
Water Utilities
30. Discussion and possible action to authorize the Purchasing Agent to advertise a Request for Proposal to solicit a highly qualified entertainment / promotion management company to bring major events / activities to the existing Webb County Fairground Facility to include but not limited to, booking promotions, producing and marketing events, and ticket sale management in order to sell live entertainment consistent with the goals and discretion of the Webb County Commissioners Court and in accordance with the Texas Local Government Code; §262.030 (Alternative Competitive Proposal Procedures for Certain Goods and Services) and any other matters incident thereto. Issue: The Webb County Commissioners Court is in need of a qualified person / group that has the capacity and knowledge to promote and book /manage all major events at the existing Webb County Fairgrounds Facility. The Webb County Purchasing Agent is recommending that this procurement delivery method be used to secure Request for Proposals under the Texas Local Government code to determine most qualified proposals and to further seek best and final offer prior to award. Solution: Authorize the Purchasing Agent to advertise a formal Request for Proposal which would allow interested parties to submit their qualifications for the services being requested, the solicitation will provide a two-step process which will allow the Webb County Commissioners Court to select proposals determined to be reasonably susceptible of being selected for award based on qualifications during step 1, then in step 2 those proposals selected as most qualified may be permitted to submit before award a revised proposal to include preliminary pricing and other evaluating factors to determine best and final offer. Result: Secure formal proposals as authorized by Commissioners Courts and return to Commissioner Court with recommendations for selection of most qualified, best and final offer and award.

Issue: The Webb County Commissioners Court is in need of a qualified individual / group that has the capacity and knowledge to operate and manage both the Webb County Fairgrounds restaurant and pavilion concession stand. Services include but are not limited to operation of the fairgrounds restaurant and pavilion concession stand in an economical, effective and healthy manner that complies with all applicable local, county, state and federal regulations. Awarded respondent will be expected to secure all necessary permits and licenses to operate a restaurant and concession stand that serves food and beverages. Solution: Approve the use of the recommended vendor who also holds a cooperative contract Buy-Board No. 670-22 Result: Issue purchase order for the approved amount. Lead time is 30–45 days, but final deliveries will not exceed 10/31/2021.
Drug Court Program
20. Discussion and possible action to continue paying grant funded personnel under the Office of the Governor, Grant #4418101, FY23 Specialty Court Program, Ninety (90) days, until notification about grant continuation award from the Criminal Justice Division (CJD) by the Office of the Governor, Public Safety Office. All personnel costs will be reimbursed with grant funds. [Requested by Margarita Herrera-Garza, Drug Court; Account #2710-1020-001-410000 (Payroll)] Issue: Current Grant funding expires August 31, 2023. The Adult Drug Court Specialty Program has not received notice of award for the grant renewal, Grant No. 4448102. Solution: Grant a 90-day payroll extension for personnel working under the grant. Result: the Drug Court will continue to provide services without interruption.

21. Discussion and possible action to enter into a Tax Abatement Agreement, pursuant to the County’s Guidelines And Criteria under the Property Redevelopment and Tax Abatement Act, Chapter 312 of the Texas Tax Code, as requested by Gransolar Texas Three, LLC, for approximately $184,000,000 in improvements related to generation of electricity using solar panels for a ten year period and being a 100% tax abatement of ad valorem taxes (maintenance and operation only), with Payments In Lieu of Taxes (PILOT payments) to be made annually to Webb County and any matters incident thereto, and authorizing the County Judge to sign all relevant documents. The property subject to the abatement agreement is located approximately 15 miles from Laredo in Southern Webb County off of US Highway 83 within the Gransolar Texas Tres Reinvestment Zone.
22. Discussion and possible action to grant a Right of Entry to SE LEGACY DEVELOPMENT, LLC and LTMM6 LAND COMPANY, LTD. for three months to enter onto Webb County property, being a 604.14 acre tract located along U.S. Hwy 83, for the purpose of conducting topographical and boundary surveys, engineering studies, planning feasibility studies, archeological and environmental inspections, mechanical vegetation clearing, geotechnical drilling and analysis, drainage and access and appraisals along a 50 foot wide by 5,753.79 foot long frontage strip of land and any matters incident thereto; authorizing the County Judge to sign all relevant documents. Discussion and possible action to approve a Resolution and Order of the Constitutional Amendments/Special Election and to authorize and establish the Early Voting Polling Locations and Election Day Sites for the November 7, 2023 Constitutional Amendment/ Special Election within Webb County, Texas pursuant to Chapter 85, Texas Election Code.
25. Discussion and possible action to approve a Resolution and Order authorizing a Joint Election between the County of Webb, the City of Rio Bravo, Legacy Municipal Management District, and the Webb County Municipal Utility District No.1 to be conducted on November 7, 2023 and authorize the Webb County Elections Administrator to prepare an election services contract for the conduct and supervision of said elections pursuant to Chapter 271, Texas Election Code.

Discussion and possible action to approve the closeout and release of retainage in the amount of $16,976.25 to Romo Contractors LLC., for the Webb County Casa Blanca Golf Course Improvements Project; and authorize the County Judge sign any relevant documents; and any other matters incident thereto. [Account #7100-206000 (Retainage Payable)] Issue: This project has been completed. Contractor is requesting final pay (retainage amount). There will be a credit of $2,375.00 from the $16,000.00 Allowance which will be credited back to the original funding source. Solution: Approve and release retainage amount and close out project. Result: Completion of project and release of retainage.

Discussion and possible action to approve the closeout and release of retainage in the amount of $26,445.00 to Gilmar Construction LTD., for the Welch Road Culvert Improvement Project; and have the County Judge sign any relevant documents; and any other matters incident thereto. [Account #2703-206000 (Retainage Payable)] Issue: The Welch Road Culvert Improvement Project has been completed. Solution: Approval to close out and release retainage. Result: Project completion and safe road for Webb County constituents and First Responders.

Discussion and possible action to approve the transfer of funds in the amount of $15,848.59 from account #3907 (series 2020) for the Quad City Fire Station / JP Renovation Project: and have the County Judge sign any relevant documents and any other matters incident thereto. [Account #3902-7230-001-474501 (Construction in Progress)] Issue: Funds are needed for Material Testing previously approved in Commissioner Court dated July 10, 2023 (Agenda Item 26) for the Quad City Fire Station / JP Renovation Project. Solution: Approve agenda item for the transfer of funds. Result: Approval of transfer of funds in order for the project to proceed.

Discussion and possible action to award Request for Qualification (RFQ) No. 2023-014 "Self Help Center Architectural Services for Rehabilitation Projects - Economic Development Contract No. CFC-22-0089" to the sole respondent Slay Architecture, LLC, and to further authorize the Civil Legal Department to prepare a professional services contract and any other matters incident thereto. The TDA grant will allow Webb County to provide rehabilitation to ten (10) homes under the Economic Development Department Contract #CFC-22-0089. Solution: Approve award to sole respondent to RFQ, Slay Architecture, LLC. Result: Proceed with preparation of a professional services contract with sole respondent for the design of plans and specifications, preparation of construction documents, preparation of bidding documents, construction oversight and construction inspections for the Webb County Colonia Fund Construction Housing Rehabilitation Grant.

Issue: The Webb County Commissioners Court is in need of a qualified person / group that has the capacity and knowledge to promote and book /manage all major events at the existing Webb County Fairgrounds Facility. The Webb County Purchasing Agent is recommending that this procurement delivery method be used to secure Request for Proposals under the Texas Local Government code to determine most qualified proposals and to further seek best and final offer prior to award. Solution: Authorize the Purchasing Agent to advertise a formal Request for Proposal which would allow interested parties to submit their qualifications for the services being requested, the solicitation will provide a two-step process which will allow the Webb County Commissioners Court to select proposals determined to be reasonably susceptible of being selected for award based on qualifications during step 1, then in step 2 those proposals selected as most qualified may be permitted to submit before award a revised proposal to include preliminary pricing and other evaluating factors to determine best and final offer. Issue: The Webb County Commissioners Court is in need of a qualified individual / group that has the capacity and knowledge to operate and manage both the Webb County Fairgrounds restaurant and pavilion concession stand. Services include but are not limited to operation of the fairgrounds restaurant and pavilion concession stand in an economical, effective and healthy manner that complies with all applicable local, county, state and federal regulations. Awarded respondent will be expected to secure all necessary permits and licenses to operate a restaurant and concession stand that serves food and beverages.
