1. CALL TO ORDER BY THE HONORABLE TANO E. TIJERINA, WEBB COUNTY JUDGE

3. Discussion and possible action for Approval of Bills, Payroll, and Monthly Reports (Auditor, Treasurer, Human Resources, Risk Management; and any other Department reports); and any other matters incident thereto.
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners. The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court. The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda. 7. Civil Legal Division
q. Discussion and possible action to authorize and approve payment to the members of the Webb County Deputy Sheriffs’ Association as agreed in the Collective Bargaining Agreement between Webb County and the Webb County Deputy Sheriffs’ Association which allows the annual leave buy back, to include those hours accrued and exceeding 20 hours of annual leave after the buy-back, calculated as of October 31 of the fiscal year for which the buy-back is available (FY2022-2023), provided that the member has submitted the Annual Leave Buy-Back Application by October 31, 2023 and any matters incident thereto. Issue: CBA permits applications for Annual Leave Buy Back to be submitted by a Member no later than Oct 31st. Solution: The Collective Bargaining Agreement with the Deputy Sheriff's Association Agreement specifically permits the Commissioners Court to resolve these and Court action authorizes payment. Result: Maintain the Collective Bargaining Agreement that was entered into in good faith with the Deputy Association pursuant to Chapter 174 of the Texas Local Government Code.
16. Webb County Fairgrounds
c. Discussion and possible action to authorize the Purchasing Agent to solicit sealed competitive bids for the delivery, installation and startup of a new Climate Control System for the Webb County’s Fairground’s exhibition barn in accordance with the Texas Government Code; Section 2269.101 (Contracts for Facilities: Competitive Bidding) and to further designate the County Engineering Department to prepare the bid specifications for requested HVAC equipment required for this project in accordance with Section 2269.102 (Use of Architect or Engineer) and any other matters incident thereto. Issue: Currently the exhibit barn is utilized for different events for vendor point of sales and exhibition purposes. Making the area a high traffic location for community events. The building has poor ventilation and during the hot summer months creating potential health hazard. Solution: Climate control for the building to maintain the proper temperature and humidity in the air environment inside the building Result: Provide a safe exhibit barn for public use.
5. Civil Legal Division PUBLIC HEARING
17. Public Hearing on establishing a reinvestment zone, to be known as Webb County Seven Flags BESS Reinvestment Zone 1 located approximately 2 miles east of Cuatro Vientos Boulevard and approximately twelve hundred feet north of Eistetter Road (a/k/a Wormser Road). CLOSE PUBLIC HEARING
18. Discussion and possible action to establish, by Order of the Webb County Commissioners Court, a reinvestment zone to be known as Webb County Seven Flags Bess Reinvestment Zone 1 on approximately 5 acres located approximately 2 miles east of Cuatro Vientos Boulevard and approximately twelve hundred feet north of Eistetter Road (a/k/a Wormser Road); directing a proposed Tax Abatement agreement be prepared; authorizing the publication of all required notices as per statute and any other matters incident thereto.

Discussion and possible action to correct the appoint/re-appoint the Civil Service Commissioners that was approved on November 14, 2022 under Item 21, for a Two – year term, commencing January 1, 2023 – December 31, 2025 to January 1, 2023 – December 31, 2024 and any other matters incident thereto. Issue: The term for each Civil Service Commissioner is two years and due to a clerical error the date of 2025 was used instead of 2024. Solution: Correct the appointment term to January 1, 2023 – December 31, 2024 in conformance with Civil Service Rules and Regulations for the appointment of a Commissioner for 2 years. Result: The appointment or re-appointment of the commissioners will insure smooth and efficiently run commission, and will provide good continuity for such an important function.
20. Discussion and possible action to appoint a new Commissioner to the Webb County Civil Service Commission due to a vacancy; and any other matters incident thereto. [Requested by the Civil Service Commission (Section 1 of the Webb County Civil Service Rules and Regulations)] Issue: Mr. Rodolfo "Rudy" Morales III has resigned from the Civil Service Board due to other commitments that will strain his time to perform his work as a Senior Attorney with the City of Laredo and LISD Board Member. Solution: Appoint a new individual to the Civil Service Commission for the unexpired term as per Civil Service Rules and Regulations. Result: Have a Complete Board.
21. Discussion and possible action to enter into a Memorandum of Understanding with the City of Laredo for a five-year period to refer Webb County Drug Court candidates to the City of Laredo Drug Court Based Substance Use Treatment Program funded by the U.S. Department of Health and Human Services for detox services and any matters incident thereto; authorizing the County Judge to sign all relevant documents. [Requested by City of Laredo and Judge Tano Tijerina, no effect on County Budget]
22. Discussion and possible action to enter into a professional services agreement with Armko Industries, Inc., to prepare a building envelope assessment (including the Roof and Parking Garage) of the New Webb County Sheriff’s Office (formerly H.E. Butt Grocery Store) in an amount not to exceed Eight Thousand Five Hundred Dollar ($8,500.00) with mobilization to occur within two weeks of execution of the agreement and 45 days to complete the assessment report and any matters incident thereto; authorizing the County Judge to sign all relevant documents. [General Fund Professional Services]
23. Discussion and possible action to approve Material Testing Work Authorization #3 with Howland Engineering and Surveying Co., for the Webb County Fairground Project in an amount not to exceed $90,600. Fill dirt material testing services are needed for site improvements and any matters incident thereto; authorizing the County Judge to execute any relevant documents. [Funding: Fairground C.O.]
Elections
24. Discussion with possible action to authorize an incentive supplementary pay to Slot #8827 (Elections Computer Systems Coordinator) in the amount of $423.08 per pay period or $11,000 for the remainder of the fiscal year; and any other matters incident thereto. [Account #1001-3120-001-410010 (Emergency Management – Incentive Supplementary)] Issue: Slot #8827 has assumed additional duties within the Elections Office but Elections Office does not have an Incentive Supplementary line item. Solution: Paying Slot #8827 an incentive through the Emergency Management Department will allow the slot to be paid a supplement while the position is reviewed by the salary committee. Result: Allow Slot #8827 to be compensated for additional duties within the Elections Dept.

25. Discussion and possible action to reject all bid submittals for Invitation to Bid No. 2023-011 “Webb County Southern Fire Station – ARPA Project No. 2 and to authorize the Project Architect and County Infrastructure Director to revise the scope of work and construction bid documents and to further authorize the Purchasing Agent to re-advertise in accordance with the Texas Government Code; §2269.151 Contracts for Facilities: Competitive Sealed Proposals (CSP) and any other matters incident thereto. [Account #2703-5205-001-474501-101 (American Rescue Plan Act of 2021-American Rescue Plan-Administration-Construction In Progress-Southern Fire Station)] Issue: The Purchasing Agent secured two (2) sealed bids. Both bids exceed the budgetary limits of this project. Staff, Project Architect and ARPA Consultant are recommending that all bids be rejected and for project scope to be modified in order to secure pricing that will not exceed ARPA funding allocated for this project. Solution: Reject all bids, modify scope of work, and re-advertise using the CSP delivery method as per Government Code Chapter 2269, contracting and delivery procedures for construction projects. Result: The Purchasing Agent will re-advertise using the CSP delivery method contingent upon construction bid documents revised and subject revisions approved by Commissioners Court.

Discussion and possible action to approve Invitation to Bid No. 2023-010 “Webb County Southern Health Facility – Project No. 70800001013” to the lowest and responsible bidder pursuant to the Texas Government Code; §2269.101 (Contracts for Facilities: Competitive Bidding and if applicable with the Code of Federal Regulations §200.318 - §200.327 (General Procurement Standards) and to further authorize the County Judge to sign all relevant construction contract documents for execution and any other matters incident thereto. [Account #3520-7230-001-470000 (TDHCA CARES Rio Bravo Health Center-Construction In Progress-Administration-Capital Outlay)] Issue: The Southern Health Facility project will provide residents access to the first time freestanding public health center in southern Webb County with a proposed area of 10,585 SF. The land is approximately 4.0208 acres northeast of Rio Bravo, Texas west right-of-way line of U.S. Hwy 83. In addition, the health center will be the new location for the Webb County Health Department, who shall operate and facilitate the center. The Department will have the opportunity to provide an array of medical and health services to the rural residents of the non-entitlement area of Webb County Solution: Consideration to approve the award to the lowest and responsible bidder as recommended by the Purchasing Agent and Project Architect. This project is funded by the Texas Department of Housing and Community Affairs (TDHCA) under the U.S. Department of Housing and Urban Development Community Development Block Grant CARES Act (CDBG-CV) program project number 70800001013. Result: If approved, authorize General Counsel to finalize the construction documents for execution by the County Judge contingent upon all Performance and Payment bond and insurance requirements are met by the awarded bidder.

27. Discussion and possible action to approve the Webb County Jury Selection Plan in accordance with Texas Government Code 62.011 with an effective date of November 1, 2023. Issue: Jury plan needs to be updated. Solution: Recommendation to Commissioner's Court for approval and to be adopted. Result: Jury Plan will be up-to-date.

28. Presentation by Dub Taylor with Texas Pace Authority with discussion and possible action to approve the Resolution of Intent to establish the Webb County Property Assessed Clean Energy (PACE) Program, in accordance with the requirements of the Property Assessed Clean Energy Act as set forth in Texas Local Government Code Chapter 399; and any other matters incident thereto. Issue: Limited funding opportunities for property owners who want to make property upgrades while remaining budget neutral. Developers want to take advantage of a low-cost, long-term replacement to expensive equity partner financing. Service or capital provider who want to offer more services to customers with low risk. Local government interested in creating jobs and improving the environment but have limited resources. Solution: Property Assessed Clean Energy (TX-PACE) is a proven financial tool that incentivizes Texas’ property owners to upgrade facility infrastructure with little or no capital outlay. Approved by State legislation and established by local governments, TX-PACE programs enable owners to lower their operating costs and use the savings to pay for eligible water conservation, energy efficiency, resiliency, and distributed generation projects. Owners gain access to private, affordable, long-term (typically 10-20 years) financing that is not available through traditional funding avenues. Result: 92 PACE Programs Established in Texas, 80 Projects Completed, $ 448,582,427 Dollars Invested, 5,702 Jobs Created, 44,563 CO2 Reduced (tonnes/yr), 77,485,416 Energy Saved(kWh/yr), 79,929 Natural Gas Saved (mmBTU/yr), 118,483,293 Water Saved (Gal/yr).

Discussion and possible action to designate Mrs. Monica Flores with Human Resources as interim director of Risk Management; with additional action requesting the authorization to reclassify the current Risk Management Director slot #317, grade 26 to a Risk Manager position, grade 24, to oversee the Risk Management operations and functions; and any other matters incident thereto.

Presentation by Dub Taylor with Texas Pace Authority with discussion and possible action to approve the Resolution of Intent to establish the Webb County Property Assessed Clean Energy (PACE) Program, in accordance with the requirements of the Property Assessed Clean Energy Act as set forth in Texas Local Government Code Chapter 399; and any other matters incident thereto. Issue: Limited funding opportunities for property owners who want to make property upgrades while remaining budget neutral. Developers want to take advantage of a low-cost, long-term replacement to expensive equity partner financing. Service or capital provider who want to offer more services to customers with low risk. Local government interested in creating jobs and improving the environment but have limited resources. Solution: Property Assessed Clean Energy (TX-PACE) is a proven financial tool that incentivizes Texas’ property owners to upgrade facility infrastructure with little or no capital outlay. Approved by State legislation and established by local governments, TX-PACE programs enable owners to lower their operating costs and use the savings to pay for eligible water conservation, energy efficiency, resiliency, and distributed generation projects. Owners gain access to private, affordable, long-term (typically 10-20 years) financing that is not available through traditional funding avenues. Result: 92 PACE Programs Established in Texas, 80 Projects Completed, $ 448,582,427 Dollars Invested, 5,702 Jobs Created, 44,563 CO2 Reduced (tonnes/yr), 77,485,416 Energy Saved(kWh/yr), 79,929 Natural Gas Saved (mmBTU/yr), 118,483,293 Water Saved (Gal/yr).
