CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners. The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court. The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. 5. Auditor
19. Discussion and possible action to authorize the County Auditor to establish a new sale tax location on behalf of Webb County Fairgrounds – Fund 2031 for applicable events subject to sales tax according to Texas Tax Code and any other matters incident thereto. Issue: Sales tax remittance is required for some of fairground services chosen by clients based on the Texas Tax Code. Solution: Webb County to apply for a new sales tax location. Result: Comply with Texas Tax Code statutes.
Medical Examiner
20. Discussion and possible action to authorize a transfer in the amount not to exceed $15,000 from payroll cost (#1001-3100-001-410000) into part-time cost (#1001-31000-001-412000) within the Medical Examiner’s office, funds are available in vacant slot that will remain unfilled for the remainder of the fiscal year; and any other matters incident thereto. Issue: Short staffed situation at the Medical Examiner’s office has resulted in the need to fill part-time temporarily. Solution: Approve transfer to have funding available for part-time. Result: Dedicated part-time staff to fill in for the duties of the office.

21. Discussion and possible action to accept the rankings and award Request for Qualifications (RFQ) 2024-007 "Labor and Employment Law Legal Services for Webb County" to the highest ranking firm, J. Cruz and Associates, in accordance with the State of Texas Government Code; Professional Services Procurement Act and to further authorize the Civil Legal Department to negotiate the terms, conditions and related fees of the professional service agreement and any other matters incident thereto. [Account #1001-1130-001-432001 (General Fund-General Operating Exp-Administration-Professional Services)] Supplier Rank Score Experience in Labor and Employment Law Personnel Qualifications References and Projects J. Solution: Consideration to accept the rankings and award to the highest ranking firm as presented by the Purchasing Agent and in accordance with the Texas Professional Services Act. Result: If approved, authorize the Civil Legal Department to negotiate the terms, conditions and fees of the professional service agreement and return to Commissioners Court for approval to execute agreement.
22. Discussion and possible action to award Invitation to Bid (ITB) 2024-001 "Carpet Removal and Installation Project" to lowest and responsible bidder, Midas Contractors LLC, in accordance with the Texas Local Government Code, Sub-Chapter C. (Competitive Bidding in General), Section 262.021 (County Purchasing Act), in an amount not to exceed $180,836.00 for all Judicial District Courts, Coutny Court at Law #1, Child Support Court and the Central Jury Room and to further authorize the County Judge to execute the contract and any other matters incident thereto. [Account #1001-1130-001-470000 (General Fund-General Operating Exp-Administration-Capital Outlay)] Issue: Commissioner Court authorized the Purchasing Agent to secure formal bids for the removal and installation of new carpet for all Judicial District Courts, County Court of Law No. 1, Child Support Court and the Central Jury Room. Four (4) sealed bids were submitted by deadline, one of which was disqualified due to incomplete bid pricing. Solution: Consideration to accept the lowest and responsible bidder’s price proposal as presented by the County Purchasing Agent for each courtroom and/or to reject all and rebid if it's in the best interest for Webb County. Result: If approved, authorize General Counsel to execute the contract for the awarded sum(s).

Discussion and possible action to accept the rankings and award Request for Proposal (RFP) 2024-003 "Webb County Fairgrounds - Floral Designer Services" to the highest ranking respondent, Narvaez Flowers and Gift Shop, in accordance with the Texas Local Government Code; §262.030 (Alternative Proposal Procedures for Certain Goods and Services) and to further authorize the Civil Legal Department to negotiate the terms, conditions and related fees of the service agreement and any other matters incident thereto. Discussion and possible action to authorize the Purchasing Agent to purchase six (6) Standard Diesel Laydown LED Light Towers with Kubota D1005 Engine & 6kw Generator with an operating height of up to 30’ from Wanco, Inc. (Buy-Board Contract No. 703-23-Highway Safety Traffic Control Products) in an amount not to exceed $86,982.50 and to further authorize the transfer of funds from the General Operating – Reserve account #1001-1130-001-431007-010 to the Fairgrounds Capital Outlay account #2031-1010-001-470000 and any other matters incident thereto. [Account #2031-1010-001-470000 (Webb County Fairgrounds-Commissioners Court-Administration-Capital Outlay)] Issue: The Webb County Fairgrounds department is requesting portable lighting towers to enhance the lighting in the parking lot areas in preparation for the upcoming events. Solution: Consideration to authorize the purchase of the recommended light towers under a buy board cooperative contract, meeting all the competitive bidding requirements of the State. Result: If approved, the towers will be ordered contingent upon the transfer of funds by the Budget and Auditors' office. ETA for delivery by or before February 23, 2024.
26. Discussion and possible action to approve the rental of one (1) 9-Station Portable Restroom Trailer and two (2) 4-Station Portable Restroom Trailers from South Texas Waste Systems (STWS) for an amount not to exceed $13,350.00 for the rental period dated February 24, 2024 – March 3, 2024, to include but not limited to delivery, setup/removal, one weekly pump out and final pump out, and services such as sweeping, mopping, daily re-stocking of toilet paper, napkins and soap for the Webb County Fairgrounds Department and to further authorize the transfer of funds from the General Operating – Reserve account #1001-1130-001-431007-010 to the Fairgrounds Repairs & Maintenance to Equipment account #2031-1010-001-443000-035 and any other matters incident thereto. [Account #2031-1010-001-443000-035 (Webb County Fairgrounds-Commissioners Court-Administration-Repairs & Maintenance-Equipment)] Issue: The Webb County Fairgrounds Department requested and as authorized by Commissioners Court the rental of portable restrooms for the upcoming events between February 24th – March the 3rd. Solution: Authorize the rental of three (3) units as presented by the Purchasing Agent. The 9th unit includes 4-private stalls for women w/sink and 2-private stalls/3 urinals for men w/sink and the 4-station unit includes 2-private stalls for women w/sink and 1-private stall / 1-urinal for men w/sink. Informal bids were advertised and only one STWS submitted a bid for the scope of services requested. Result: If approved by the Commissioners Court, order will be placed contingent upon posting of the budget amendment for the requested sum of $13,350.00.
27. Discussion and possible action to authorize the purchase of one (1) Heavy Duty 5 Gang Golf Ball Picker with Universal A-Frame Attachment from Range Servant America, Inc. for an amount not to exceed $7,290.42, for the Webb County Casa Blanca Golf Course and to further authorize the transfer of funds form the General Operating-Reserve account #1001-1130-001-431007-010 to the Casa Blanca Golf Course – Capital Outlay account #7100-6080-001-470000 and any other matters incident thereto. [Account #7100-6080-001-470000 (Casa Blanca Golf Course - Golf - Administration - Capital Outlay)] Issue: The Webb County Casa Blanca Golf Course requested, and is in need of one (1) new ball picker for the driving range. Golf Course management is in the process of making improvements to the driving range section to improve the surface area to minimize the wear and tear on ball picker equipment. Solution: Authorize the purchase as presented by the Purchasing Agent. Informal bids were secured for this purchase. Range Servant America has provided the lowest and best bid. Result: If approved by Commissioners Court, order will be placed contingent upon posting of budget amendment for the requested sum of $7,290.42.
28. Discussion and possible action to authorize the Purchasing Agent to secure competitive cooperative pricing for the purchase of two (2) Modular Ice Makers with a 580 lbs. Ice Storage Capacity in an amount not to exceed $13,680.00 for the Webb County Fairgrounds and to further authorize the transfer of funds from the General Operating – Reserve account #1001-1130-001-431007-010 to the Fairgrounds Minor Tools and Apparatus account #2031-1010-001-460105 and any other matters incident thereto. [Account #2031-1010-001-460105 (Webb County Fairgrounds-Commissioners Court-Administration-Minor Tools & Apparatus)] Issue: The Webb County Fairgrounds Department requested and as authorized by Commissioners Court, the purchase of two ice machine with high production quantities for scheduled events and other uses for day to day operations. Solution: Authorize the purchase as presented by the Purchasing Agent. Pricing will be secured under cooperative contracts that have met all the competitive bidding requirements of the State and the Webb County Purchasing Policy. Result: If approved by Commissioners Court, order will be placed contingent upon posting of budget amendment for the requested sum of $13,680.00.
29. Discussion and possible action to authorize the Purchasing Agent to secure competitive cooperative pricing for the purchase of Eight (8) Industrial Sized Evaporator Coolers with a 46 gallon capacity and up to 3,600 sq. ft. of coverage in an amount not to exceed $33,600.00 for the Webb County Fairgrounds and to further authorize the transfer of funds from the General Operating – Reserve account #1001-1130-001-431007-010 to the Fairgrounds Minor Tools and Apparatus account #2031-1010-001-460105 and any other matters incident thereto. [Account #2031-1010-001-460105 (Webb County Fairgrounds-Commissioners Court-Administration-Minor Tools & Apparatus)] Issue: The Webb County Fairgrounds Department requested and as authorized by Commissioners Court, the purchase of multiple industrial-sized portable coolers to utilize in their respective facilities to circulate airflow in those areas that lack climate control systems. Solution: Authorize the purchase as presented by the Purchasing Agent. Pricing will be secured under State approved cooperative contracts that have met all the competitive bidding requirements of the State and the Webb County Purchasing Policy. Result: If approved by Commissioners Court, order will be placed contingent upon posting of budget amendment for the requested sum of $33,600.00.

30. Discussion and possible action to enter into Work Authorization #2 with Howland Engineering at a cost not to exceed Six Thousand Four Hundred Twenty-Five Dollars ($6,425.00) for a Boundary Survey for Tract C-14 +/- 20 acres (Tract C- 14A and Tract C-14B) Botines Subdivision, Webb County, Texas (auxiliary site for Road and Bridge Department storage and road maintenance operations) and any matters incident thereto; authorizing the County Judge to sign all relevant documents. 31. Discussion and possible action to approve the appointment of a County representative to the Laredo Economic Development Corporation Board of Directors for One (1) year term. [Requested by Laredo Economic Development Corporation]
32. Discussion and possible action to authorize the Webb County Purchasing Agent to solicit Request for Qualifications from individuals and/or firms for the development of a Space Needs Assessment Study for Webb County Facilities to evaluate the efficiency of existing workspaces, prepare short, mid-range and long term recommendations on spacing requirements, to include budgetary cost estimates for related capital planning pursuant to the Professional Services Act and any other matters incident thereto.
33. Discussion and possible action to authorize a county sponsorship in the amount of Fifteen Thousand ($15,000.00), from Hotel/Motel funds to the Casa Blanca Golf Course in anticipation of their upcoming annual Webb County Open golf tournament in Laredo, Webb County, Texas, with further action to transfer $15,000 from Account #2004-1010-001-463609 (TAMIU Alumni Association); and any other matters incident thereto. [Hotel/Motel Community Promotion Account #2004-1010-001-463526] Issue: Casa Blanca Golf Course will host its annual Webb County Open golf tournament on April 11-14, 2024 and Webb County will be the title sponsor of this event. Solution: Sponsorship amount will be used to offset expenses and allow for promotional items to be distributed. Result: Adequate and successful promotion of Webb County, Casa Blanca Golf Course, and the annual Webb County Open golf tournament.
34. Discussion and possible action to direct staff to formulate recommendations for additional office and related spaces for county operations and any other matters incident thereto.
10. Closed Session/Executive Session
35. Discussion and possible action to approve a property settlement and release agreement with Kemper Insurance on behalf of Jesus Gamboa Parez as a result of a motor vehicle accident that occurred on October 28, 2022, on Saunders and McClelland Street, Laredo, Texas, and any other matters incident thereto. [Executive Session may be requested pursuant to Texas Government Code, Title 5, Subchapter D, Section 551.071(1)(B) (Consultation with attorney regarding pending settlement offer)] Issue: A two-vehicle collision involving Sheriff motor vehicle unit 27-396 (2021 Ford Explorer) and a 2007 Chevrolet Suburban driven by Gamboa Parez, damage was sustained on both vehicles. Solution: To approve the property settlement regarding Sheriff motor vehicle unit 27-396. Result: Once property settlement is approved, Webb County, as Claimant, will release Mr. Parez and his insurance carrier (Kemper) for all property claims regarding Unit 27-396.

Solution: Consideration to accept the rankings and award to the highest ranking firm as presented by the Purchasing Agent and in accordance with the Texas Professional Services Act. Result: If approved, authorize the Civil Legal Department to negotiate the terms, conditions and fees of the professional service agreement and return to Commissioners Court for approval to execute the agreement.

Discussion and possible action to authorize the Purchasing Agent to purchase six (6) Standard Diesel Laydown LED Light Towers with Kubota D1005 Engine & 6kw Generator with an operating height of up to 30’ from Wanco, Inc. (Buy-Board Contract No. 703-23-Highway Safety Traffic Control Products) in an amount not to exceed $86,982.50 and to further authorize the transfer of funds from the General Operating – Reserve account #1001-1130-001-431007-010 to the Fairgrounds Capital Outlay account #2031-1010-001-470000 and any other matters incident thereto. [Account #2031-1010-001-470000 (Webb County Fairgrounds-Commissioners Court-Administration-Capital Outlay)] Issue: The Webb County Fairgrounds department is requesting portable lighting towers to enhance the lighting in the parking lot areas in preparation for the upcoming events. Solution: Consideration to authorize the purchase of the recommended light towers under a buy board cooperative contract, meeting all the competitive bidding requirements of the State. Result: If approved, the towers will be ordered contingent upon the transfer of funds by the Budget and Auditors' office. ETA for delivery by or before February 23, 2024.

Discussion and possible action to approve the rental of one (1) 9-Station Portable Restroom Trailer and two (2) 4-Station Portable Restroom Trailers from South Texas Waste Systems (STWS) for an amount not to exceed $13,350.00 for the rental period dated February 24, 2024 – March 3, 2024, to include but not limited to delivery, setup/removal, one weekly pump out and final pump out, and services such as sweeping, mopping, daily re-stocking of toilet paper, napkins and soap for the Webb County Fairgrounds Department and to further authorize the transfer of funds from the General Operating – Reserve account #1001-1130-001-431007-010 to the Fairgrounds Repairs & Maintenance to Equipment account #2031-1010-001-443000-035 and any other matters incident thereto. [Account #2031-1010-001-443000-035 (Webb County Fairgrounds-Commissioners Court-Administration-Repairs & Maintenance-Equipment)] Issue: The Webb County Fairgrounds Department requested and as authorized by Commissioners Court the rental of portable restrooms for the upcoming events between February 24th – March the 3rd. Solution: Authorize the rental of three (3) units as presented by the Purchasing Agent. Discussion and possible action to authorize the purchase of one (1) Heavy Duty 5 Gang Golf Ball Picker with Universal A-Frame Attachment from Range Servant America, Inc. for an amount not to exceed $7,290.42, for the Webb County Casa Blanca Golf Course and to further authorize the transfer of funds form the General Operating-Reserve account #1001-1130-001-431007-010 to the Casa Blanca Golf Course – Capital Outlay account #7100-6080-001-470000 and any other matters incident thereto. [Account #7100-6080-001-470000 (Casa Blanca Golf Course - Golf - Administration - Capital Outlay)] Issue: The Webb County Casa Blanca Golf Course requested, and is in need of one (1) new ball picker for the driving range. Golf Course management is in the process of making improvements to the driving range section to improve the surface area to minimize the wear and tear on ball picker equipment. Solution: Authorize the purchase as presented by the Purchasing Agent. Informal bids were secured for this purchase. Range Servant America has provided the lowest and best bid. Discussion and possible action to authorize the Webb County Purchasing Agent to solicit Request for Qualifications from individuals and/or firms for the development of a Space Needs Assessment Study for Webb County Facilities to evaluate the efficiency of existing workspaces, prepare short, mid-range and long term recommendations on spacing requirements, to include budgetary cost estimates for related capital planning pursuant to the Professional Services Act and any other matters incident thereto.

Discussion and possible action to authorize a county sponsorship in the amount of Fifteen Thousand ($15,000.00), from Hotel/Motel funds to the Casa Blanca Golf Course in anticipation of their upcoming annual Webb County Open golf tournament in Laredo, Webb County, Texas, with further action to transfer $15,000 from Account #2004-1010-001-463609 (TAMIU Alumni Association); and any other matters incident thereto. Discussion and possible action to approve a property settlement and release agreement with Kemper Insurance on behalf of Jesus Gamboa Parez as a result of a motor vehicle accident that occurred on October 28, 2022, on Saunders and McClelland Street, Laredo, Texas, and any other matters incident thereto. [Executive Session may be requested pursuant to Texas Government Code, Title 5, Subchapter D, Section 551.071(1)(B) (Consultation with attorney regarding pending settlement offer)] Issue: A two-vehicle collision involving Sheriff motor vehicle unit 27-396 (2021 Ford Explorer) and a 2007 Chevrolet Suburban driven by Gamboa Parez, damage was sustained on both vehicles. Solution: To approve the property settlement regarding Sheriff motor vehicle unit 27-396. Result: Once property settlement is approved, Webb County, as Claimant, will release Mr. Parez and his insurance carrier (Kemper) for all property claims regarding Unit 27-396.
