CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners. The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court. The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. 16. Discussion and possible action to authorize the budget amendment to transfer court reporter incentive authorized by order on the adoption of the budget in the amount not to exceed $12,000 plus fringe ($14,536 total). [Funding source: Account #1001-1130-001-431007-005 (Payroll Reserve)] Issue: The following incentive monies were not allocated during the preparation of the budget since it was a vacant court reporter slot at the time. Incentives were only budgeted for filled slots. Solution: Approve the proposed change to have funding for incentive. Result: Ability for department to process incentive worksheet for the court reporter assigned.

Discussion and possible action to approve the closeout and release of 5% retainage in the amount of $10,000.00 to PHT Enterprises, LLC for the construction of the Sacred Heart Children’s Home-Boy’s and Teenager’s Cottage Sewer Renovation Plus through the Non-Governmental Organizations ARPA Sub-Award and for the County Judge to sign any relevant documents and any other matter incident thereto. [Account #2703-5205-001-463701-120] Issue: Five percent (5%) of the construction project amount is held in retainage from the contractor for 30 days from completion date of each project to ensure that any deficiencies which may arise are addressed by the contractor. The contract amount is $20,000,00 and 5% retainer amount is $10,000,00. Solution: Commissioners Court authorizes the release of the retainer funds to the contractor. Result: The contractor will be paid for services rendered.
Human Resources
18. Discussion with possible action to authorize the grade/step revisions for the below mentioned positions, and any other matters incident thereto. [Requested by Wage Review Committee; Account #1001-1130-001-431007-015 (Wage Classification Study)] Position From: To: Fairgrounds Director Grade 25/J Grade 26/J Human Resources Director Grade 26/L Grade 28/J Capital Projects-Infrastructure Director Grade 27/J Grade 28/J Utilities System Director Grade 26/R Grade 28/J Information Technology Director Grade 27/S Grade 28/O Issue: These positions were reviewed by the Webb County classification and wage consulting services provider, Segal Waters Consulting, and it was determined that the positions required a grade and salary change based on a market analysis performed. These recommendations were reviewed and approved by the Wage Review Committee. Solution: Approve the proposed changes discussed and approved by the Wage Review Committee. Result: Positions will be classified appropriately per market analysis.
8. Civil Legal Division PUBLIC HEARING
19. Public Hearing on establishing a Reinvestment Zone, to be known as the Webb County Cedro Hill Wind Reinvestment Zone Number 1. The Proposed Reinvestment Zone comprises approximately 24,600 acres and is located approximately 34 miles east of Laredo and north of the town of Oilton, Texas. CLOSE PUBLIC HEARING
20. Discussion and possible action to establish, by Order of the Webb County Commissioners Court, a reinvestment zone to be known as the Webb County Cedro Hill Wind Reinvestment Zone Number 1. The Proposed Reinvestment Zone comprises approximately 24,600 acres and is located approximately 34 miles east of Laredo and north of the town of Oilton, Texas.; directing a proposed Tax Abatement agreement be prepared; authorizing the publication of all required notices as per statute and any other matters incident thereto. [No effect on the budget]
9. Community Action Agency
21. Discussion with possible action to modify the American Rescue Plan Act (ARPA) Contract #ARPA-0008 performance statement and budget for the Community Action Agency (CAA) Meals-on-Wheels Facility Project to include the Webb County Community Action Agency Administration and Community Social Services Program to the project and authorize the Webb County Judge to sign all relevant documentation. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) Procedures. [Account #2703-5205-006] Issue: Webb County Community Action Agency Administration and Social Services require a long-term facility that suits the needs of the services they provide to the community. Solution: Modify the Meals on Wheels Facility Project to include Webb County Community Action Agency Administration and Social Services into the facility. Result: The new facility will be a unified location, with adequate space for the services provided for the Webb County Community Action Agency Administration, Social Services, and Meals on Wheels Program.
10. Planning
22. Discussion and possible action to pre-approve the qualifying applicants for Private On-Site Sewage Facility Assistance (OSSF) under ARPA Project No. 6 and authorize Planning Department staff and ARPA Project Manager to initiate the final scope of work and required specifications for the Purchasing Agent to solicit competitive bids for the installation of the septic systems for each qualifying applicant and any other matters incident thereto. Issue: Applicants that meet the criteria of the grant Guidelines are required to be approved by the Commissioners Court prior to securing competitive bids for the installation of approved septic systems for those qualifying applicants. All applicants meet the residency and property criteria outlined in the adopted Guidelines and the Planning staff recommends pre-approval. Solution: Court approval will allow staff to finalize the scope of work and required specifications of septic systems for the solicitation of formal bids. Result: Qualifying applicants will receive the OSSF installation services and Guideline requirements will be met.

Discussion and possible action to authorize the purchase of One (1) Kaufman 30 foot Flatbed Trailer including warranty for one year for an amount not to exceed $26,590.00 from Kaufman Trailers, LLC for the Water Utilities Department and any other matters incident thereto. [Account #7200-7050-001-470000 (Water Utility Administration-Capital Outlay)] Issue: Water Utilities was approved through the fiscal year 2024 budget for a one (1) flatbed trailer to be utilized to transport heavy-duty equipment for the department. Solution: Consideration to award the purchase from Kaufman Trailers, LLC. Funding is available in the Utilities Department capital budget. Result: If approved, the order will be initiated immediately after the Commissioners Court meeting. Estimated time of delivery is projected at 8 to 10 weeks.

Discussion and possible action to authorize the purchase of one (1) 2025 Peterbilt 548 14' Dump Truck from Rush Truck Center (Buy-Board Cooperative Contract No. 723-23) for an amount not to exceed $218,319.92 pursuant to the Texas Local Government Code; Sections 271.101, 271.102, Sub-Chapter F. Cooperative Purchasing Programs and any other matters incident thereto. [Account #7200-7050-001-470000 (Water Utility Administration-Capital Outlay)] Issue: The Water Utilities Department was approved to purchase one (1) dump truck for the fiscal year ending 2024. Solution: Consideration to authorize the purchase with budgeted funds under Capital Outlay. The vendor has a cooperative contract meeting the competitive bidding requirements of the state. Result: If approved, the order will be placed after court meeting. Build time to begin is approximately between November to December 2024 and final delivery ETA between December 2024 and January 2025.

Discussion and possible action to accept the rankings and award Request for Qualifications (RFQ) 2024-010 "Webb County Roadway Speed Study" for Civil Engineering services to the highest ranking firm, AC Group LLC, to inlcude both the City of Oilton and Los Altos Colonia Area of Hwy. 59 pursuant to the Texas Government Code; Chapter 2254 (Professional Services Procurement Act) and to further authorize General Counsel to negotiate the terms, conditions and related fees of the professional service agreement and any other matters incident thereto. On February 12, 2024, commissioners court authorized the purchasing agent to secure Statement of Qualifications (SOQ) from interested firms for Civil Engineering Services for a speed study to address these concerns. Solution: Consideration to accept the rankings presented by the purchasing agent and award to the highest ranking firm in accordance with published criteria based solely on qualifications. Two firms submitted SOQ. Result: If approved, authorize General Counsel to proceed with negotiations to finalize the term, conditions and related fees of the professional service agreement for Commissioners Court approval.

Discussion and possible action to approve line item transfer to resolve the Webb County Constable Office Pct. 3 payroll overage in the amount of $13,368.00 (Operation Stone Garden 2022 grant); and any other matters incident thereto. This occurred by a clerical mistake (internally) in budgeting the allotted funds at a deputy pay scale of $20.90 and not taking into account adjustments necessary for ranking officers working the grant at a different rate of pay. Solution: By seeking assistance from Commissioners Court to approve line item transfer from the Operational Reserve Account #1001-1130-001-431007-010 would circumvent any issues with employees regarding wages for hours worked. Result: The administrative staff of the Webb County Constables Office PCT. 3 will work closely with the assigned internal project director for OPSG grant and implement internal audits/modules and have said budget reports checked with County Auditors to ensure that this incident is avoided in the future.
