3. Discussion and possible action for Approval of Bills, Payroll, and Monthly Reports (Auditor, Treasurer, Human Resources, Risk Management; and any other Department reports); and any other matters incident thereto.
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners. The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court. The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. Drug Court Program
19. Discussion and possible action to continue paying grant funded personnel under the Office of the Governor, Grant No. 4448102, FY24 Specialty Court Program, Ninety (90) days, until official notification about the grant continuation award is received from the Criminal Justice Division (CJD) by the Office of the Governor, Public Safety Office. All personnel costs will be reimbursed with grant funds. [Account #2710-1020-001-410000 (Payroll)] Issue: Current Grant funding expires August 31, 2024. The Adult Drug Court Specialty Program has not received notice of award for the grant renewal, Grant No. 4448103. Solution: Grant a 90-day payroll extension for personnel working under the grant. Result: The Drug Court will continue to provide services without interruption.
7. Economic Development
20. Discussion and possible action to authorize Five Hundred Thousand Dollars ($500,000) in cash matching funds for a community facilities program application to the U.S. Department of Agriculture (USDA) Rural Development and authorizing the Webb County Judge to act as the county's executive officer and authorized representative in all matters pertaining to the county's participation in the USDA Rural Development Community Facilities Program; and authorizing the county judge to execute any and all relevant documents and any other matters incident thereto. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. No impact to the general fund. [Co-Sponsored by Commissioner Jesse Gonzalez, Pct 1] Issue: USDA -RD requires a county cash match to complete the project. Solution: Webb County provides a cash match to complete the project. Result: Webb County completes the project.
8. Human Resources
21. Discussion and possible action to recognize, acknowledge, and accept the retirement of the Webb County Water Utilities Director effective September 30th, 2024 and to further appoint an interim director and solicit qualified applicants for the position; and any other matters incident thereto.
22. Discussion and possible action to review the recommendations of the Wage and Pay Committee regarding Elected Official salaries and any other matters incident thereto.
9. Business Office
23. Discussion and possible action to authorize the Business Office and Auditors Office to enter and post-budget amendments for fiscal year-end transactions necessary to process payment of all invoices dated or services rendered on or before September 30, 2024. Line item transfers are to be determined by the Business Office in coordination with the Auditors Office and presented for ratification. Issue: Various departments and offices have depleted departmental budgets nonetheless there are invoices pending to be processed that must be paid with FY 2023-2024 funds. Invoices cannot be validated if the accounts are negative. Solution: In order to timely process and pay invoices, Business Office will identify line items transfers and perform administrative budget amendments as needed to process invoices. A list of invoices pending process due to insufficient funds will be generated and provided to the Budget Officers by the Business Office. Result: Invoices will be processed and sent to the Auditors for approval.
10. Elections
24. Discussion and possible action for the Order of Joint General/Special Elections and to authorize and establish the Main and Temporary Branch Early Voting Polling Sites and Election Day Sites for the November 5, 2024 Joint General/Special Elections within Webb County, Texas pursuant to Chapter 85, Texas Election Code.
11. Purchasing
25. Discussion and possible action to accept rankings and award Request for Proposal (RFP) 2024-010 "Client Tracking Management Software" to CAP Systems Inc., for the Community Action Agency Social Services, with a total one-time costs of $19,000.00 and monthly ongoing costs $1,500.00 totaling $18,000.00 per year subject to budget appropriations and in accordance with the Texas Local Government Code, §262.030 (Alternative Proposal Procedures for Certain Goods and Services) and any other matters incident thereto. Discussion and possible action to authorize the purchase of twelve (12) APX-6000 Enhanced VHF Portable radios including programming and installation for a total amount not to exceed $68,902.00 from Motorola (HGAC Contract No. RA05-21) for the Webb County Sheriff's Office and in accordance with the Texas Local Government Code; Sub-Chapter F. Cooperative Purchasing Program, §271.101, §271.102 (Cooperative Purchasing Program Participation) and any other matters incident thereto. [Account #2716-3010-001-470000 Capital Outlay - SB 22 Sheriff's Office Rural Law Enforcement] Issue: Grant funding is available for the purchase of needed law enforcement safety equipment in the form of portable radios. Solution: Consideration to authorize grant funded equipment for law enforcement use. Motorola has a cooperative contract with HGAC, meeting all competitive bidding requirements of the State of Texas. Result: If approved, proceed with placing the order.
27. Discussion and possible action to reject all competitive sealed proposals (CSP) submitted for CSP 2024-005 “Webb County Fairgrounds Parking Lot Improvements – Phase III project and to further authorize the Purchasing Agent to solicit for an annual contract for parking lot paving repair and maintenance services on an as needed basis with possible options to extend as directed by Commissioner Court pursuant to the Texas County Purchasing Act and any other matters incident thereto. Issue: The highest ranking offeror’s total base bid (asphalt option) of $4,047,000.75 or total base bid + alternate #1 (concrete option) of $7,321,385.00 exceeded the projected construction costs anticipated by Webb County. Solution: Recommendation to reject all bids submitted for this project and consider authorizing the Purchasing Agent to solicit bids for an annual contract for parking lot paving repair and maintenance services as needed by the Webb County Fairgrounds department and/or other departments. Result: If approved, bidders who participated in this solicitation will receive a rejection letter and a formal solicitation for the recommended services will be published as authorized by the Webb County Commissioners Court.
12. Risk Management
28. Presentation by Randy McGraw, HUB International Texas, Inc. (County's Benefits Consultant) with discussion and possible action to adopt the proposed plans and rates for premiums for the employee health insurance plan (to include vision, dental, and stop loss renewals) for the next calendar year, January 1,2025, thru December 31, 2025, and any other matters incident thereto. Issue: The current premiums and plans may require adjustments to progressively maintain funding levels when recommended. Solution: Adjust premiums and/or plans based on usage and expenditures when recommended. Result: Progressively and appropriately manage and fund the County's health plans.
13. Honorable Margie Ibarra, County Clerk OPEN PUBLIC HEARING
29. Public hearing to consider and discuss the Archival Plan for Fiscal Year 2024 - 2025 for funding of the automation project and records management and preservation services performed by the Webb County Clerk. This plan includes a Records Archive Fee of $10.00 pursuant to Texas Local Government Code Section 118.025, effective September 1, 2019. CLOSE PUBLIC HEARING
30. Discussion and possible action to approve the Archival Plan for Fiscal Year 2024 - 2025 for funding of the automation project and records management and preservation services performed by the Webb County Clerk. This plan includes a Records Archive Fee of $10.00 pursuant to Texas Local Government Code Section 118.025, effective September 1, 2019.
14. Honorable Patricia Barrera, Tax-Assessor- Collector
31. Discussion and possible action to authorize the increase in change fund for the Webb County Tax Office for the amount of $5,000.00 as per Local Government Code 130.902 and any other matters incident thereto. Issue: Currently the teller boxes daily starting box is for $200, making the tellers request for change several times throughout our busiest times of the day and having to go to the bank in several occasions as well. Solution: We would like for the Commissioner to approve the increase of the change fund for our department in order to increase teller boxes from $200 to $300 and to be able to request adequate change from our financial institution every morning without having to disrupt our work flow throughout our busiest days. Result: Authorization of a change fund increase will alow our department to have the necessary currencies on hand to issue to our tellers when neeed when payments are taken in cash, and ability to create new teller boxes.
32. Discussion and possible action to levy a Tax Rate of $0.385000 per $100 Taxable value by Order, under the provisions of Article VIII, Section 9(a) and 9(b) of the Texas Constitution and Section 26.05 of The Texas Property Code for Tax Year 2024. The rate includes $0.342824 per $100 value for General Fund Maintenance and Operation; $0.027759 per $100 value for General Fund – Debt Service Bonds; $0.014122 for Road & Bridge Fund M&O; $0.000295 for Road & Bridge – Debt Service Bonds. 33. Discussion and possible action to re-schedule the Court meeting for the adoption of the proposed budget and Tax Rate for fiscal year 2024-2025; and any other matters incident thereto.
15. Honorable Raul Reyes, Treasurer
34. Discussion and possible action to revise the Educational Qualifications for the Chief Principal Accountant Position. Issue: The current job description for the Chief Principal Accountant position requires a Master’s degree, but recent recruitment efforts have failed to attract enough qualified candidates, limiting the talent pool. Solution: Revise the job description to allow candidates with a Bachelor’s degree and at least 7 years of relevant work experience to qualify, considering this combination as equivalent to a Master’s degree. This change aims to expand the pool of eligible applicants and improve recruitment success. Result: The Commissioners Court has reviewed and approved the revision to the job description, broadening the educational qualifications. Candidates with a Bachelor’s degree and 7 years of relevant work experience are now eligible for consideration, increasing the potential to attract more qualified applicants for the position.
Budget Officer
35. Discussion and possible action to approve, by Order, the following budget amendment (line item transfer) within the General fund: Acct. Number Acct. Name Request From: 1001-1130-001-431007-010 Operational Reserve $240,000 To: 1001-1130-001-432001 Professional Services $240,000 Issue: Previous items approved required a budget amendment to complete payment process. As per Auditors, requesting formal line item transfer for funding. Solution: Approve and process budget amendment. Result: Funding necessary to complete payment process.
17. Commissioners Court Administrator
36. Discussion and possible action to enter into a Tax Abatement Agreement, pursuant to the County’s Guidelines and Criteria under the Property Redevelopment and Tax Abatement Act, Chapter 312 of the Texas Tax Code, as requested by Gransolar Texas Two LLC, dba Cuchillas Bess, for approximately $278,000,000 in improvements related to the storage of electricity using batteries for a ten year period and being a 100% Tax Abatement of Ad Valorem Taxes (Maintenance And Operation Only), with Payments In Lieu Of Taxes (Pilot Payments) to be made annually to Webb County and any matters incident thereto, and authorizing the County Judge to sign all relevant documents. The property subject to the abatement agreement comprises approximately 1,243 acres and is located approximately 14 miles east of Laredo and approximately 1.4 miles south of United States Highway 59 within the Webb County Gransolar Texas Two LLC, dba Cuchillas Bess Reinvestment Zone Number 1. [No effect on current county budget]
37. Discussion and possible action to amend the agreement (AIA B101-2017 dated May 28, 2024) with Juan Homero Sanchez Architect, Inc. for the Webb County Veterans Building Rehabilitation and Preservation to include an additional reimbursement of Twenty-Seven Thousand Two Hundred Fifty Dollars ($27,250) for additional services to be provided for clearing, securing and documenting the project and any matters incident thereto, authorizing the County Judge to sign all relevant documents. [Funding Source: ARPA Revenue Replacement Funds]
38. Discussion and possible action to enter into a professional services contract with Madeline Anz Slay Architects LLC for a Space Needs Assessment for the Fesco Building, Justice Center, Billy Hall Administration Building, Sheriffs Building and the Indigent Health/Engineering Building in an amount not to exceed Two Hundred Forty-Nine ($249,000.00) and any matters incident thereto; authorizing the County Judge to sign all relevant documents. 39. Discussion and possible action regarding the request of Clear Choice Hospital LLC regarding an economic development incentive for its project to be located at the Coves at Winfield and any matters incident thereto.

40. Discussion and possible action to have the Purchasing Agent issue a Request for Qualifications for a Civil Engineer to provide plans, specs, and opinions of probably costs for various paving projects (roadway and parking, i.e. Zaragoza Street parking lot) and to assist the County in establishing minimum road standards and specifications for County roads (both caliche, overlays and new road construction) and any matters incident thereto.

Discussion and possible action to review and decide upon the Schematic Design for the Webb County Veterans Building Rehabilitation and Preservation Project and confirm the construction budget as presented by Juan Homero Sanchez Architect, Inc. and any matters incident thereto. Discussion and possible action to authorize the Purchasing Agent to solicit formal Request for Proposals for a Construction Manager at Risk (CMAR) to serve as a general contractor for the rehabilitation and preservation of the Webb County Veterans Museum building pursuant to the Texas Government Code; §2269.251 (Contracts for Facilities: Construction Manager at Risk) and to further authorize the use of a one-step process, Webb County may request as part of offerors proposal, proposed fees and prices for fulfilling the general conditions and any other matters incident thereto. [Co-Sponsored by Ricardo Jaime, Commissioner Pct. 4] Issue: Project Architect has been hired to develop the plans and specifications for the Rehabilitation and Preservation of the Webb County Veterans Museum Building. Webb County is now seeking to use the Construction Manager-at-Risk as the project delivery method for the selection of a general contractor for the rehabilitation and preservation of the building. Solution: The Purchasing Agent recommends using the one-step process to select the offeror who is best qualified for this project and who will provide the best value proposal based on the published criteria and proposed fees / pricing for fulfilling the general conditions. The County will provide during the formal solicitation general information on the project site, project scope, schedule, selection criteria and relative weighting of selection criteria, estimated budget, time/place for receipt of the proposals or qualifications, and any other information that would assist the Commissioners Court in its selection of a CMAR. Result: If approved, the Purchasing Agent will proceed with the formal solicitation for a CMAR as per the Texas Government Code and as authorized by the Webb County Commissioners Court.

Discussion and possible action to enter into negotiations and a release/settlement agreement between Webb County for the Webb County Constables Office Pct. 1 and the Law Offices of Guillermo Del Barrio for Sabino Morales regarding a claim for money; and authorizing the Webb County Judge to sign all relevant documents and any other matters incident thereto. Discussion and possible action to authorize the increase in change fund for the Webb County Tax Office for the amount of $5,000.00 as per Local Government Code 130.902 and any other matters incident thereto. Issue: Currently the teller boxes daily starting box is for $200, making the tellers request for change several times throughout our busiest times of the day and having to go to the bank in several occasions as well. Solution: We would like for the Commissioner to approve the increase of the change fund for our department in order to increase teller boxes from $200 to $300 and to be able to request adequate change from our financial institution every morning without having to disrupt our work flow throughout our busiest days. Result: Authorization of a change fund increase will alow our department to have the necessary currencies on hand to issue to our tellers when neeed when payments are taken in cash, and ability to create new teller boxes.

Discussion and possible action to levy a Tax Rate of $0.385000 per $100 Taxable value by Order, under the provisions of Article VIII, Section 9(a) and 9(b) of the Texas Constitution and Section 26.05 of The Texas Property Code for Tax Year 2024. Issue: The current job description for the Chief Principal Accountant position requires a Master’s degree, but recent recruitment efforts have failed to attract enough qualified candidates, limiting the talent pool. Solution: Revise the job description to allow candidates with a Bachelor’s degree and at least 7 years of relevant work experience to qualify, considering this combination as equivalent to a Master’s degree. This change aims to expand the pool of eligible applicants and improve recruitment success. Result: The Commissioners Court has reviewed and approved the revision to the job description, broadening the educational qualifications. Candidates with a Bachelor’s degree and 7 years of relevant work experience are now eligible for consideration, increasing the potential to attract more qualified applicants for the position.

The property subject to the abatement agreement comprises approximately 1,243 acres and is located approximately 14 miles east of Laredo and approximately 1.4 miles south of United States Highway 59 within the Webb County Gransolar Texas Two LLC, dba Cuchillas Bess Reinvestment Zone Number 1. Webb County is now seeking to use the Construction Manager-at-Risk as the project delivery method for the selection of a general contractor for the rehabilitation and preservation of the building. Solution: The Purchasing Agent recommends using the one-step process to select the offeror who is best qualified for this project and who will provide the best value proposal based on the published criteria and proposed fees / pricing for fulfilling the general conditions. The County will provide during the formal solicitation general information on the project site, project scope, schedule, selection criteria and relative weighting of selection criteria, estimated budget, time/place for receipt of the proposals or qualifications, and any other information that would assist the Commissioners Court in its selection of a CMAR.
