3. Discussion and possible action for Approval of Bills, Payroll, and Monthly Reports (Auditor, Treasurer, Human Resources, Risk Management, Tax Assessor-Collector; and any other Department reports); and any other matters incident thereto.
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners. The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court. The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda. 7. Honorable Jesse Gonzalez, Webb County Commissioner Pct. 1
a. Discussion and possible action to enter into intra agency Memorandum of Understanding with the Webb County Utilities Department to obligate the ARPA State and Local Fiscal Recovery Funds in that amount of $7,485,232.00 for the Utilities Department to carry out the La Press Booster Pump Station Project and La Pres Waterline Extension Phase II and any matters incident thereto; authorizing the County Judge and Utilities Director to sign all relevant documents. [ARPA Funds in the amount of $7,485,232.00]
20. 1848 Event Center
a. Discussion and possible action to approve the posting and filling of the following Slot, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective November 25, 2024: Slot # Title Salary 4054 Maintenance Worker $31,518.75 - $33,124.48 (1/ A-E) Issue: Request to approve the filling of vacant slot. Solution: Request is being made to post and fill slot #4054. Result: This action will allow our department to continue to function efficiently and effectively.
Honorable Victor Villarreal, County Court at Law #2 Judge
21. Discussion and possible action per Local Government Code 291.001, “the commissioners court of a county shall: (1) provide, as soon as practicable after a county seat is established or moved, a courthouse and offices for county officers at the county seat.”; and any other matters incident thereto. Designating Julio Garcia Room located on the 4th floor of the Dean Senator Judith Zaffirini Justice Center to house the offices and staff of the DWI Court & Youth Center for Success. Issue: Webb County Court-at-Law II has been awarded two state grants to expand its existing federal grant specialty court programs. The WCCLII court is in need of contiguous space adjacent to its main court offices to accommodate full-time personnel and comply with the safety occupancy code. Solution: Commissioners Court approved the Julio Garcia Room adjacent to the WCCLII courtroom for the courts exclusive use. No agreements have been reached since the last commissioners' court meeting between the stakeholders regarding mutually agreeable use of space. Result: Per Commissioners Court approval and WCCLII assessment and research, the Julio Garcia Room continues to be the best placement for the specialty court staff.
6. Fire Marshal
22. Discussion and possible action to adopt the National Fire Protection Association (NFPA) 855, which provides guidelines for the safe installation and operation of energy storage systems; and any other matters incident thereto. Issue: The need for standardized safety guidelines for the installation and operation of energy storage systems to ensure compliance with industry standards and mitigate associated risks. Solution: Adopt NFPA 855, the National Fire Protection Association's standard for the installation of energy storage systems, which provides comprehensive safety protocols and installation guidelines. Result: The formal adoption of NFPA 855 will improve safety, ensure regulatory compliance, and provide a clear framework for energy storage system installations.
7. Auditor
23. Discussion and possible action to approve, by order, a budget amendment in the amount of $185,000 for the Election Service Contracts (Fund #2010); and any other matters incident thereto. [Account #2010-1110-001-451201 (Election Expense)] [Sponsored by Jose Luis Castillo, Elections Administrator] Issue: The Election Service Contract Fund require additional funding for early voting and election day invoices. Solution: Budget amendment is required to pay invoices timely for early voting and election day invoices. Result: The County Election Administrator will process invoices timely for payment.
8. Planning
24. Discussion and possible action to authorize County staff to draw the necessary funds in an amount up to $4,641,494.88 from the amended standby Letter of Credit No. SBP702794 (International Bank of Commerce) as required to complete pending public road improvements required by the final plat of the Gateway Unit 1 Subdivision in the event that, on or before December 6, 2024, the developer fails to either: 1) complete the final improvements as required by the final plat approval of the Gateway Unit 1 Subdivision plat; or 2) provide a reasonable time extension to the financial guarantee. Issue: Item is a regulatory compliance matter of the Subdivision Regulations and State law. In lieu of completion of public improvements triggered by plat requirements at the time of the Court’s final approval, a developer may submit a financial guarantee to ensure the completion of those pending improvements. Time extensions to financial guarantees are authorized by the Subdivision Regulations. The current financial guarantee expires December 6, 2024. Since an extension has not been filed, this item has been placed for the court’s authorization to draw the funds. Solution: Drawing the funds will allow the County to ensure completion of public improvements and compliance with Subdivision Regulations and State law. Result: Subdivision Regulations and State law requirements will be met.

Discussion and possible action to accept the rankings and award Request for Qualifications (RFQ) 2025-004 “Legislative Consulting Services for Webb County" to the highest ranking respondent, McWilliams Governmental Affairs Consultants, to provide legislative consulting services on an “as needed basis” for a three (3) year service term under the direction and supervision of the Webb County Commissioners Court pursuant to the State of Texas Government Code; Professional Services Procurement Act and to further authorize General Counsel to proceed with the preparation of the professional services agreement and any other matters incident thereto. The licensed counselor(s) shall provide services to participants of the Webb County Head Start/Early Head Start in the capacity of a mental health consultant, including developing mental health program activities and providing training to Head Start staff and parents in order to meet the needs of the Head Start students. The proposed term of service is for three (3) years, pursuant to the Texas Government Code; §2254 – The Professional Services Procurement Act., and to further authorize General Counsel to prepare a professional service agreement with awarded offeror(s) and any other matters incident thereto. Discussion and possible action to award Competitive Sealed Proposal (CSP) 2025-003 “ARPA Project No. 3 –Webb County Emergency Operation Center” to sole Proposer 360 General Contractors, Inc. for an amount not to exceed $1,292,944.49 (Base Bid) pursuant to the Texas Government Code; §2269.151 Contracts for Facilities: Competitive Sealed Proposals and with the Code of Federal Regulations §200.318 - §200.327 (General Procurement Standards) and to further authorize General Counsel to prepare the construction contract for the awarded sum and any other matters incident thereto. [Account #2703-5205-001-474501 (American Rescue Plan Act of 2021-American Rescue Plan-Administration-Construction In Progress-Emergency Operation Center)] Issue: This project is part of the federally funded projects approved by Webb County as part of its allocation of American Rescue Plan Act (ARPA) funds. The EOC will be located at 1002 Farragut Street, 2nd floor. This emergency management center will be under the direction of the Webb County Judge. Solution: Consideration to approve sole bidder/proposer in accordance with the Texas Government Code Chapter 2269, CSP delivery procedures for construction projects and selection of offeror. Result: If approved, General Counsel will prepare a construction contract for final approval by Commissioners Court at the next regular scheduled meeting to include any federal contract provisions required.
28. Discussion and possible action to award Invitation to Bid (ITB) 2025-001 “Rio Bravo Road Improvements USDA-RD / ARPA Project No. 28” to the lowest responsible bidder - Renoworks, LLC., for an amount not to exceed $1,749,954.70 (Base Bid) for a scope of work to include but not limited to a 2” asphalt overlay of approximately 3.612 miles of roadway, mobilization, barricades, signs and traffic handling, concrete removal and man-hole lid lifting and stripping of nine (9) roadways in the Rio Bravo Community pursuant to the Texas Government Code; §2269.101 Contracts for Facilities: Competitive Bidding and with the Code of Federal Regulation §200.318 - §200.327 (General Procurement Standards) and to further authorize the Webb County Judge to enter into an agreement between Webb County and Renoworks, LLC for Construction Contract (EJCDC documents) for the awarded sum subject to final approval by Grantor USDA-RD and any other matters incident thereto. [USDA-RD Grant - $1,099,954.70, Webb County ARPA Match $500,000.00, and the City of Rio Bravo ARPA Match $150,000.00 - Construction in Progress / Rio Bravo Street Improvements] Issue: This project is part of the federally funded projects approved by Webb County as part of its allocation from USDA-RA and local matches from both Webb County and the City of Rio Bravo - American Rescue Plan Act (ARPA) funds. Solution: Consideration to award to the lowest and responsible bidder as presented by the Webb County Purchasing Agent. Result: If approved, General Counsel will prepare and execute the EJCDC construction documents for the awarded sum to include any required federal contract provisions and subject to final approval by Granting Agency - USDA-RA.
29. Discussion and possible action to approve the purchase of one (1) Manitou Telehandler MTA 5519 S3 from Bobcat of Corpus Christi, Texas (Source-well Contract #020223-CEC) in the amount not to exceed $81,500.00, includes a standard 2 year/2000 hour warranty pursuant to Sections 271.101 and 271.102 of the Texas Local Government Code, Cooperative Purchasing program; and any other matters incident thereto. [Account #2007-7150-001-470000 (Road and Bridge Road Maintenance - Capital Outlay)] Issue: The Webb County Road and Bridge Department has capital outlay funding that includes the approval of one (1) Manitou Telehandler MTA 5519 S3 for lifting of heavy and bulky loads. Equipment can also be utilized as a fork lift, but has a more versitile, powerful and greater reach for daily operational use. Solution: Consideration to purchase the Manitou Telehandler from Bobcat of Corpus Christi utilizing Source-well cooperative contract pricing. Equipment was approved through the FY 24-25 budget process. Result: If approved, the order will be initiated immediately after Commissioners' Court meeting. Estimated time of delivery is 3-5 days.
10. Risk Management
30. Discussion and possible action to amend the Group Insurance policy provided by The Standard Insurance Company to include continued coverage for participants during school breaks and vacation. The amended language is as follows: Continued insurance during school vacations - If you cease to be a Member because of a school break or vacation, your insurance will be continued during that period. This amendment will become effective October 1,2024, through December 31, 2025; and authorize the Webb County Judge to sign all relevant documents and any other matters incident thereto. [Account #6100-1090-001-432057 (Cafeteria Administration)] Issue: Headstart employees are off working during certain school breaks and/or vacation breaks the policy needs to specifically include language to address these employees. Solution: Commissioners Court approval amending the policy to include the specific language as stated above insures coverage for Head Start employees. Result: Approval for this amendment would guarantee coverage to Head Start employees during breaks and prevent claim delays.
1848 Event Center
31. Discussion and possible action to transfer $100,000 to part time, and $1000,000 to overtime line item ($200,000 total) from payroll reserve (Account #1001-1140-001-431007-005) for event security of certified licensed peace officers at 1848 Event Center; and any other matters incident thereto.

32. Discussion and possible action to adopt the proposed Legislative Agenda 2025 for Webb County for the upcoming 89th Texas Legislature as recommended by the Legislative Affairs Committee; and authorize the County Judge to execute a Resolution recognizing the official action of Commissioners Court; and any other matter incident thereto. Discussion and possible action to award Invitation to Bid (ITB) 2025-001 “Rio Bravo Road Improvements USDA-RD / ARPA Project No. 28” to the lowest responsible bidder - Renoworks, LLC., for an amount not to exceed $1,749,954.70 (Base Bid) for a scope of work to include but not limited to a 2” asphalt overlay of approximately 3.612 miles of roadway, mobilization, barricades, signs and traffic handling, concrete removal and man-hole lid lifting and stripping of nine (9) roadways in the Rio Bravo Community pursuant to the Texas Government Code; §2269.101 Contracts for Facilities: Competitive Bidding and with the Code of Federal Regulation §200.318 - §200.327 (General Procurement Standards) and to further authorize the Webb County Judge to enter into an agreement between Webb County and Renoworks, LLC for Construction Contract (EJCDC documents) for the awarded sum subject to final approval by Grantor USDA-RD and any other matters incident thereto. [USDA-RD Grant - $1,099,954.70, Webb County ARPA Match $500,000.00, and the City of Rio Bravo ARPA Match $150,000.00 - Construction in Progress / Rio Bravo Street Improvements] Issue: This project is part of the federally funded projects approved by Webb County as part of its allocation from USDA-RA and local matches from both Webb County and the City of Rio Bravo - American Rescue Plan Act (ARPA) funds. Solution: Consideration to award to the lowest and responsible bidder as presented by the Webb County Purchasing Agent. Result: If approved, General Counsel will prepare and execute the EJCDC construction documents for the awarded sum to include any required federal contract provisions and subject to final approval by Granting Agency - USDA-RA.

Discussion and possible action to approve the purchase of one (1) Manitou Telehandler MTA 5519 S3 from Bobcat of Corpus Christi, Texas (Source-well Contract #020223-CEC) in the amount not to exceed $81,500.00, includes a standard 2 year/2000 hour warranty pursuant to Sections 271.101 and 271.102 of the Texas Local Government Code, Cooperative Purchasing program; and any other matters incident thereto. [Account #2007-7150-001-470000 (Road and Bridge Road Maintenance - Capital Outlay)] Issue: The Webb County Road and Bridge Department has capital outlay funding that includes the approval of one (1) Manitou Telehandler MTA 5519 S3 for lifting of heavy and bulky loads. Equipment can also be utilized as a fork lift, but has a more versitile, powerful and greater reach for daily operational use. Solution: Consideration to purchase the Manitou Telehandler from Bobcat of Corpus Christi utilizing Source-well cooperative contract pricing. Equipment was approved through the FY 24-25 budget process. Result: If approved, the order will be initiated immediately after Commissioners' Court meeting. Estimated time of delivery is 3-5 days.
10. Risk Management
30. Discussion and possible action to amend the Group Insurance policy provided by The Standard Insurance Company to include continued coverage for participants during school breaks and vacation. The amended language is as follows: Continued insurance during school vacations - If you cease to be a Member because of a school break or vacation, your insurance will be continued during that period. This amendment will become effective October 1,2024, through December 31, 2025; and authorize the Webb County Judge to sign all relevant documents and any other matters incident thereto. [Account #6100-1090-001-432057 (Cafeteria Administration)] Issue: Headstart employees are off working during certain school breaks and/or vacation breaks the policy needs to specifically include language to address these employees. Solution: Commissioners Court approval amending the policy to include the specific language as stated above insures coverage for Head Start employees. Result: Approval for this amendment would guarantee coverage to Head Start employees during breaks and prevent claim delays.
1848 Event Center
31. Discussion and possible action to transfer $100,000 to part time, and $1000,000 to overtime line item ($200,000 total) from payroll reserve (Account #1001-1140-001-431007-005) for event security of certified licensed peace officers at 1848 Event Center; and any other matters incident thereto.

Discussion and possible action to adopt the proposed Legislative Agenda 2025 for Webb County for the upcoming 89th Texas Legislature as recommended by the Legislative Affairs Committee; and authorize the County Judge to execute a Resolution recognizing the official action of Commissioners Court; and any other matter incident thereto.
