Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.
 
COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

a.   Discussion and possible action to designate Slot #1866 as the 406th Judicial District Court's one statutory set coordinator salary. 9.   Community Action Agency
 
a.   Discussion and possible action to approve the FY 2025 Comprehensive Energy Assistance Program (CEAP) Supplemental Contract #5895004438 between the Texas Department of Housing and Community Affairs (TDHCA) and Webb County Community Action Agency (CAA) in the amount of NINETY-TWO THOUSAND ONE HUNDRED TWENTY-TWO DOLLARS ($92,122.00); authorizing the Webb County Judge to sign all relevant documents; and any other matters incident thereto.  The contract shall commence on January 01, 2025, and shall end on December 31, 2025. This action concerns a grant contract, and, thus, will not have an impact on the General Fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue:
 The Texas Department of Housing and Community Affairs (TDHCA) has awarded the Webb County Community Action Agency $92,122.00 of supplemental grant funds under the Comprehensive Energy Assistance Program (CEAP).

Solution: The Court’s approval and acceptance of grant funds will allow the Webb County CAA to provide direct services to eligible low-income residents of Webb County under the CEAP Program.

Result: The Webb County Community Action Agency will be able to assist eligible low-income Webb County residents with up to 3-6 months of payments towards their outstanding electric bills.

b.   Discussion and possible action to approve the carryover budget of Eighty-Six Thousand Seven Hundred Twenty-Eight Dollars and Thirty-Six Cents ($86,728.36) under the Comprehensive Energy Assistance Program(CEAP) as well as One Hundred One Thousand Two Hundred Eighty-two dollars and eighty-seven cents ($101,282.87) under the Comprehensive Energy Assistance Program Emergency Supplemental(CEAP Emergency Supplemental) as awarded by the Texas Department of Housing and Community Affairs(TDHCA) through contracts #58240004040 and #58940004188 to FY25. Request made for fund accounts #2362-5150-521 (Administration), #2362-5360-521 (Direct Services), #2365-5150-521 (Administration), and #2365-5360-521 (Direct Services).

Issue: Year end balances must be carried over to continue providing services to qualified individuals through to the end of the contract term.

Solution: Approve the budget to be carried over to FY 2025.

Result: The carryover approval will allow for the continuation of services.

11.   Honorable Rolando San Miguel, Constable Pct. 4
 
a.   Discussion and possible action to approve the acceptance of overtime and fringe benefits of the grant funded State and Local Overtime and Authorized Expense/Strategic Initiative Program under the Organized Crime Drug enforcement Task Force. OCDETF will cover $21,740.50 in overtime from Fund Source 2602.  Also, to increase fringe benefits accounts of $5,065.00 by Constable Pct. 4 State Forfeiture Fund #2201 to cover fringe benefits, therefore no impact to the General Fund.

Issue: Approval from Commissioners Court to continue providing fringe benefits covered by Constable Pct. 4 for the 2024-2025 fiscal year.

Issue: Chief administrators of law enforcement agencies that meet the criteria must submit racial profiling reports to their governing body, as well as TCOLE.

12.   Honorable Isidro Alaniz, District Attorney
 
a.   Discussion and possible action enter into a Thity-six (36) month Agreement between Webb County for the benefit of the Webb County District Attorney’s Office and Thompson Reuters, said software “Co-Counsel” will be only for the District Attorney’s Office and shall commence after a 6 month complimentary period of use February 1, 2025 through July 31, 2025 at a monthly cost THREE THOUSAND NINETY-SIX DOLLARS AND THIRTY-FOUR CENTS ($3,096.34) subject to annual budget appropriations, and authorizing the County Judge to sign and execute all relevant documents and any other matters incident thereto. Issue: Programs like West ProFlex are already in use by the defense, giving them an extra tool to prepare for and try cases.
 
Solution: Consideration to approve and enter into an agreement with Thomson Reuters for West ProFlex.
 
Result: The purchase of such a program will provide Webb County District Attorney’s Office with access to the West ProFlex software that will allow us to perform in a more efficient manner.

13.   Economic Development
 
a.   Discussion and possible action to accept the award and enter into an agreement with the Texas Division of Emergency Management (TDEM) DR-4705-0011-TX in the amount of $130,122.40 for the Hazard Mitigation Plan project, and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto.
 
Issue: Notice of Award from Texas Division of Emergency Management for the Hazard Mitigation Grant Program was received on January 6, 2025. Webb County currently does not have a Hazard Mitigation Plan.  
 
Solution: Acceptance of this award will assist Webb County in forming a Hazard Mitigation plan that will reduce the loss of life and property by minimizing the impact of disasters.
 
Result: Funding will be provided to Webb County.

b.   Discussion and possible action to authorize the submission of the Substance Abuse and Mental Health Administration (SAMHSA) Continuation Grant application as developed, written, and submitted by and for the Webb County Adult Drug Court Program in an amount of Four Hundred Thousand Dollars ($400,000.00) and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any kind of match; therefore, there is no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: SAMHSA awarded a multi-year grant to the Webb County Adult Drug Court Program on 09/30/2023 and the funding agency requires the submission of a non-competing continuation application for subsequent years after year 1 of funding.
 
Solution: Authorize the submission of Year 3 continuation application for the Drug Court.

Result: Webb County Adult Drug Court Program will remain in compliance with SPOC, and with the submission rules and regulations set forth by the funding agency.

a.   Discussion and possible action to approve the "Annual Report to the Public" for the 2023 - 2024 Program Year and to make available to the public via the Head Start website at https:www.webbcountytx.gov/HeadStart/AnnualReport/default.

Issue: Annually, the Head Start program must publish and disseminate a report that complies with section 644 (a) (2) of the Head Start Act and includes a summary of the most recent community assessment, as described in section 1302.11 (b) consistent with privacy protections in subpart C of part 1303 of the chapter. 

Solution: Approve the posting of the Annual Report to the Public on the Head Start website.

Result: The Head Start program will be in compliance with reporting information to the public.

17.   Purchasing
 
a.   Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to the public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.

Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause such as, wear and deterioration, damaged, or obsolete that has no value and/or usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose of or destroy property that cannot be sold through public auction because it has been deemed worthless or disposed of through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments.

b.   Discussion and possible action to enter into a Sixty-Six (66) month (April 1, 2025, through September 30, 2030) Copier Lease and Maintenance Agreement between Toshiba Business and Financial Solutions (DIR Cooperative Contract #DIR-CPO-4426) and Webb County for an amount not to exceed $66,696.52 per Quarter for equipment lease costs and an unlimited print allowance for black ink and an allowance of 360,000 prints per quarter for color for maintenance coverage for a total of 130 copiers that will be expiring September 30, 2025, with an overall total estimated savings of $10,643.00 per quarter compared to our current equipment lease and maintenance rates pursuant to Sections 271.101 and 271.102, Texas Local Government Code, Cooperative Purchasing program and to further authorize the County Judge to sign all relevant documents and any other matters incident thereto. Issue: The current Toshiba Master agreement for County wide copiers will expire on September 30, 2025. 
 
Solution: The DIR Cooperative pricing offered by Toshiba will allow the County to recognize a combined savings of $10,643.00 per quarter compared to the current monthly expenses from the lease and maintenance of 130 copiers utilized by County departments.  Projected annual savings will be $42,572.00 per fiscal year for both the leasing of the equipment and the maintenance coverage.
 
Result: Securing a long-term copier and maintenance agreement under DIR Cooperative pricing from Toshiba will recognize over $234,142.00 in savings over the term of the contract and will assist with annual budgetary projections and contract management by securing all copiers under one agreement that will start and end on the same lease terms.

a.   Discussion and possible action to revise the current number of years of experience for the newly created and approved Truancy Case Manager, grade 16 position from five (5) years of experience working with adolescents specifically with the truancy population and related juvenile and minor programs to two (2) years or more experience with juvenile or minor programs.

Purpose: The proposed changes would be more aligned with the grade of the position and would allow for further candidates to be considered.

Recommendation: For the Commissioners Court to approve the revision.

a.   Discussion and possible action to enter into an agreement for Case File preservation and Archival Indexing of historical documents between Webb County for the benefit of the County Clerk's Office and Kofile Technologies, Inc. (TXMAS Contract No. 93-92001) in the amount of $656,084.54 pursuant to the Texas Local Government Code: Sub-Chapter F. cooperative Purchasing Program, Sections 271.101, 271.102 (Cooperative Purchasing Participation) and to further authorize General Counsel to prepare the agreement for the awarded sum and any other matters incident thereto. [Account #2003-2310-001-432001 (County Clerk Archive Fund-County Clerk-Administration-Professional Services)]

Issue: The Webb County Clerk is requesting professional services for the preservation of case files and archival indexing of historical documents.

Solution: Consideration to authorize the agreement between Webb County and Kofile Technologies utilizing the cooperative contract pricing proposal which has met the competitive bidding requirements of the State of Texas.  

Result: If approved, General Counsel will prepare the agreement for final approval by Commissioners Court for the awarded sum.

Solution: Enter into an agreement with TR Facility Services, LLC whose services will include the construction and erection of a netting barrier for the Casa Blanca Golf Course Driving Range.
 
Result: Webb County will be able to protect patrons and the general public from errant golf balls being hit off the Casa Blanca Driving Range.

25.   Discussion and possible action to authorize the Purchasing Agent to secure competitive bids and/or cooperative pricing for the purchase of furniture, capital outlay equipment and computer hardware/software for the Webb County Southern Fire Department in an amount not to exceed $75,000.00 and to further authorize the transfer of funds from the General Reserve Fund (#1001-1130-001-470000 - Capital Outlay) to the Fire Departments minor tools and apparatus, material and supplies and capital outlay accounts and any other matters incident thereto. Issue: New Southern Fire Station will require furniture, computer hardware/software, lockers, and other equipment necessary for day to day operations.  

Solution: Consideration to authorize the procurement of requested equipment / supplies and the transfer of funds.

Result: If approved, orders will be placed to process the requested items for new fire station.

26.   Discussion with possible action to allow an exemption and approve the current Part-time Special Events Security hourly rate to $40.00 per hour, a rate higher than the rate currently allowed by Webb County policy for part-time employees; and any other matters incident thereto. 

Issue: The 1848 Event Center is seeking a rate increase to be able to retain part-time Special Events Security.

Solution: Webb County Commissioners Court approval to increase the hourly rate paid to part-time Special Events Security.

Result: The 1848 Event Center will be able to retain part time Special Events Security.

27.   Discussion and possible action to authorize a one-time expense to the Webb County credit card for the purchase of a 4 pack set (30) total of Rapid Radios Nationwide Push to Talk Walkie Talkies for an amount not to exceed $5,400.00 from Rapid Consulting LLC, and any other matters incident thereto. [Account #1001-1130-001-431007-010]
 
Issue: Requesting permission to use Webb County credit card for this purchase. Rapid Consulting LLC, does not accept purchase orders. Portable radios are needed for dead spots in rural county areas for 1848 Event Center staff and security. 
 
Solution: Authorize the purchase of a set of rapid radios to test its capabilities. No subscriptions and/or cell phone services are required.  Nationwide range.
 
Result: If approved, the County’s credit card will be used for this one-time purchase.

Issue: Our office does not currently have Body Cameras and our In-Car Video Systems is currently not working.
 
Solution: Consideration to authorize the transfer of funds for the requested law enforcement equipment and Cloud subscription services for the protection of the public and Patrol Officers.  And to further secure video/audio data collected during routine traffic stops and/or other calls for evidence that may be requested by the Courts.
 
Result: If approved, order will be placed after Court meeting.  ETA on delivery of equipment and installation is 8-12 weeks.
